Special Management Area (SMA): August 26, 2004 — SMA Minor Permit No. 162 was <br /> approved for installation of electrical utility poles and overhead powerline within an <br /> existing 15-ft wide easement that covered 12 parcels (including the subject parcels) <br /> located along the road. <br /> 6. Chapter 343, HRS: The applicants published a Final Environmental Assessment (FEA) <br /> Finding of No Significant Impact (FONSI) in the March 8, 2024, issue of the <br /> Environmental Notice in accordance with Hawaii Revised Statutes (HRS) Ch. 343. <br /> 7. State Land Use Conservation District — As the project area is located within the State <br /> Land Use Conservation District, the applicants will be required to obtain a Conservation <br /> District Use Permit (CDUP) from the State Board of Land and Natural Resources <br /> (BLNR)prior to any proposed land uses are conducted. <br /> 8. State Historic Preservation Division (SHPD) — The proposed project application, AIS, <br /> CIA, and development plans were submitted to SHPD for their review and consideration <br /> pursuant to HRS Ch. 6E-42. To date no response has been received. <br /> STATE AND COUNTY PLANS <br /> 9. State Land Use Designation: Conservation <br /> 10. General Plan LUPAG MAP: Open <br /> 11. County Zoning: Agriculture 1-acre (A-la). However, County zoning does not apply <br /> within the State Land Use (SLU) Conservation District, and any proposed land uses are <br /> regulated via Hawaii Administrative Rules (HAR) Ch. 13-5, Conservation District. <br /> 12. Puna Community Development Plan (PCDP): The Puna Community Development <br /> Plan (PCDP) was adopted by the Hawaii County Council by Ordinance No. 08-166 in <br /> 2008 and amended by Ordinances Nos. 10-104, 11-51, 11-52, 11-53, 11-117 and 11-118 <br /> in 2010 and 2011). <br /> -2- <br />
