(Planning Department Exhibit 3 - State Land Use Boundary Amendment <br /> and Change of Zone Applications Dated November 1, 2022) <br /> BACKGROUND INFORMATION <br /> 6. June 22, 1993: Effective date of Change of Zone Ordinance No. 93-65 which rezoned <br /> the subject property from an Agricultural 5-Acres (A-5 a) zoning district to a <br /> Neighborhood Commercial (CN-7.5) zoning district for the northern half of the subject <br /> parcel closest to the highway. <br /> 7. September 12,2012: Effective date of Change of Zone Ordinance No. 02 10, which was <br /> initiated by the Planning Director to repeal Ordinance. No. 93 65 and revert the <br /> previously CN-zoned area back to the original A-5a zoning due to noncompliance with <br /> the conditions of approval. <br /> 8. June 30,2021: The applicant submitted an application for a State Land Use Boundary <br /> Amendment from Agricultural to Urban for a portion of the subject property and a <br /> Change of Zone from an Agricultural- 5 acre (A-5a) zoning district to a Neighborhood <br /> Commercial-10,000 square feet(CN-10) and Single-Family Residential-10,000 square <br /> feet(RS-10) zoning district in order to develop three commerical lots and six single- <br /> family residential lots. The application was considered by the Leeward Planning <br /> Commission on November 18, 2021. The Planning Commission had concerns with the <br /> boundary amendment from Agricultural to Urban and change of zone from A-5a to RS- <br /> 10 zoning, which could have allowed up to 23 lots (although the applicant was proposing <br /> six), within the area designated for small farms and ranches in the South Kohala CDP. <br /> The Planning Commission believed it was not appropriate to change the southern portion <br /> of the property to urban zoning and an urban state land use boundary district. Thus, the <br /> application was subsequently withdrawn by the applicant on January 26, 2022. At that <br /> time, the applicant stated they wished to review development options and would resubmit <br /> with new applications. <br /> -3- <br />
