(C) State specifically the reasons for exceptions to the ruling, <br /> finding, conclusion, or recommendation. <br /> (e) Testimony Before the Commission: <br /> (1) If a person involved in the proceedings desires to testify before the <br /> Authority, a written request with reasons therefor shall accompany <br /> the exceptions and the Commission may grant such request. <br /> (2) The Commission may on its own motion re-open the hearing to <br /> allow the taking of additional testimony and further evidence. <br /> (f) Commission Action: <br /> (1) In the event no statement of exception is filed, the Commission <br /> may proceed to reverse, modify or adopt the recommendation of <br /> the hearing officer. <br /> (2) Upon the submittal of exceptions and the taking of further <br /> evidence, if any, Commission shall render its decision pursuant to <br /> Rule 9-11(e). <br /> 9-22 Petition for the Adoption, Amendment or Repeal of Rule 9 Special Management <br /> Area Rule of the County of Hawaii <br /> (a) Petition <br /> Any person may petition the Commission through the Director requesting <br /> the adoption, amendment or repeal of any provision of this rule. <br /> The petitioner shall be responsible for submitting the following to the <br /> Director: <br /> (1) The completed petition including: <br /> (A) A statement of the nature of the petitioner's interest. <br /> (B) A draft of the substance of the proposed rule or amendment <br /> or a designation of the provisions sought to be repealed. <br /> (C) An explicit statement of the reasons in support of the <br /> proposed rule, amendment or repeal. Said reasons shall <br /> include a discussion of the relationship of the proposed <br /> change with Chapter 205A, HRS, Relating to Coastal Zone <br /> Management, and other applicable State and County <br /> 9-25 <br />
