The Commission may amend the Special Management Area <br /> boundaries only upon finding that the amendments will further the <br /> objectives and policies as provided by Chapter 205A,HRS, and will <br /> be consistent with the General Plan and other applicable ordinances. <br /> (4) Decision and Order: <br /> The procedures shall be the same as under Section 9-11(f). <br /> (b) Special Management Area Boundary Amendments Initiated by the <br /> General Public: <br /> (1) Application: <br /> Any person may apply to the Commission through the Director <br /> requesting the amendment of the Special Management Area <br /> boundaries. <br /> The applicant shall submit the following to the Department: <br /> (A) The completed application including the following: <br /> (i) A statement of the nature of the applicant's interest. <br /> (ii) A description of the properties involved in sufficient <br /> detail to determine the precise location. <br /> (iii) An explicit statement of the reasons in support of the <br /> request including a discussion of how the <br /> amendment will further the Special Management <br /> Area objectives and policies as well as be consistent <br /> with the General Plan and other applicable <br /> ordinances. <br /> (iv) A statement discussing the proposed use of the parcel <br /> and any other information necessary to render a <br /> proper decision relating to the specific request. <br /> (B) Five hundred ($500) dollars filing fee to cover publication <br /> and other administrative costs. <br /> (2) Notice and Hearing <br /> The notice and hearing procedures shall be the same as stipulated <br /> under Section 9-11(c) and (d). <br /> 9-27 <br />
