presented at the hearings, hereby makes the following Findings of Fact, Conclusions of Law, <br /> and Decision and Order: <br /> FINDINGS OF FACT <br /> If it should later be determined that any of these findings of fact should be properly <br /> deemed conclusions of law, they shall be deemed as such. <br /> A. PROCEDURAL MATTERS <br /> 1. On May 28, 2024, the applicant filed an application with the County of Hawai`i <br /> Planning Department (hereinafter"Department"). <br /> 2. On June 8, 2024, the Department sent a letter to the Applicant indicating that their <br /> application was accepted for processing on May 28, 2024. <br /> 3. By memorandum dated June 8, 2024 with copies of the Application enclosed, the <br /> Department solicited comments on the Application to various County, State, and Federal <br /> agencies. The agencies included were the Department of Public Works-Engineering Division, <br /> Building Division &Traffic Division, the Department of Water Supply, the Fire Department, the <br /> Department of Environmental Management, the Police Department, the Hawaii State <br /> Department of Land and Natural Resources, the Hawaii State Department of Health and the <br /> Hawai`i State Office of Planning and Sustainable Development. <br /> 4. The Applicant notified the Department that the first notice of application filing <br /> was sent to surrounding property owners on June 18, 2024. <br /> 5. The Applicant notified the Department that on June 18, 2024 signage was posted <br /> on the property. <br /> 6. On July 5, 2024, the Department informed the Applicant that a hearing before the <br /> Windward Planning Commission had been set for August 1, 2024. <br /> 2 <br />
