Merit Appeals Board <br />August 12, 2024 <br />MS. TOKIHIRO: Yes, we'll put something out to the departments that gives them the exact <br />language that should appear at the bottom of the letter. <br />We did also notice that the County website incorrectly listed the number of days, in order to file <br />the appeal—and then, one of the notices that was actually being sent out from our Recruitment <br />and Examination Division. So, what we're doing is going through and looking at all that to <br />make sure that the language is consistent with the MAB Rule. <br />CHR. CABANAS: Okay, thank you so much. So, the clarification isdo we need a motion for <br />that? <br />MS. TOKIHIRO: I will just also note that for us internally—like, if I'm providing an <br />Administrative Review we do generate a letter, which is mailed to the individual who <br />requested it, but we also are emailing it on the same day. <br />So, the date of the letter would be the date of my decision and it's being transmitted to the parry <br />on that same day, because I wanted to make sure that there aren't any delays and they're being <br />allowed the full 20 days from the date of the decision. <br />CHR. CABANAS: Okay. <br />MS. TOKIHIRO: So, if something isn't sent out by noon on that day, it's going to wait until the <br />next day, but we date it accordingly to be fair. <br />CHR. CABANAS: Okay. <br />MR. KUNZ: That's announced to the appellant that it will be emailed as well? I mean, is that a <br />process known somewhere? Because I imagine that you can send an email and we can trust that <br />it got there unless it went in Spam or something else that the email is no longer becomes, sort of, <br />null that it never got them—gotten to them. <br />MS. TOKIHIRO: Right. And so, that's why we use email for our current employees where we <br />know that the email is active, although we cannot guarantee that someone is in the office to <br />check it. But we also do hard copy mail as well to make sure that they receive it. <br />CHR. CABANAS: If it's, say, recruitment issue and examination issueNeoGov sends that <br />the staff sends the notice through NeoGov <br />MS. TOKIHIRO: NeoGovcorrect. <br />CHR.
