373 4) All activities that are proposed within a designated or potential historic district <br /> 374 are Tier 3 Activities. The SOI Qualified Professional(s) will review the <br /> 375 activities to determine whether they will alter, either directly or indirectly, the <br /> 376 characteristics that qualify, or may qualify, the historic district, as well as the <br /> 377 historic bridge or structure, for listing in the NRHP. The SOI Qualified <br /> 378 Professional(s) will gather additional information, as necessary for the review <br /> 379 of the historic district, including, but not limited to, the NRHP nomination, <br /> 380 SHPO records, town web sites, as well as county master plans, and other county <br /> 381 records, as appropriate. Designated and/or potential historic districts will be <br /> 382 noted on the Compliance Form (Appendix C). To determine whether the <br /> 383 activities have an effect on an historic district(s), the SOI Qualified <br /> 384 Professional(s)will consider the characteristics that qualify, or may qualify, the <br /> 385 historic district for the NRHP following guidance in National Register Bulletin <br /> 386 15:How to Apply the National Register Criteria for Evaluation. <br /> 387 C. Limitations on Ground Disturbing Activities <br /> 388 For Hawai'i Historic Bridge Program projects qualifying as Tiers 1, 2, or 3 activities, <br /> 389 ground disturbances will not take place or be limited to avoid or minimize the <br /> 390 potential to impact archaeological resources as described in this stipulation. Any <br /> 391 ground disturbing activity not conforming to these limitations shall not be covered <br /> 392 by this Agreement. <br /> 393 1) Ground-disturbing activities for qualifying projects, including scour <br /> 394 countermeasures and foundation repairs, may take place within a strict 10-foot <br /> 395 Archaeological Clear Zone, as measured from the furthest edge of the <br /> 396 superstructure and substructure of the existing historic bridge or structure. <br /> 397 2) If an old bridge abutment or pier, retaining wall, flume or irrigation structure <br /> 398 (referred to as remnant structure) is identified in the vicinity of the historic <br /> 399 bridge, its treatment shall be a Tier 3 activity. The treatment of remnant <br /> 400 structures shall be limited to three options: <br /> 401 a) avoidance of the remnant structure <br /> 402 b) minor repair of the remnant structure following the guidance manual. <br /> 403 c) this Agreement does not apply because the remnant structure cannot be <br /> 404 avoided, or major repairs are required. <br /> 405 3) Driven poles for signage, guardrails and other types of roadside appurtenances <br /> 406 are allowable within the Right of Way and outside of the 10-foot <br /> 407 Archaeological Clear Zone for poles with a maximum 4-inch diameter to be <br /> 408 driven no more than a depth of 48 inches below existing ground surfaces. <br /> DRAFT FINAL <br /> Programmatic Agreement for the <br /> Hawai'i Historic Bridge Program 11 January 2, 2025 <br />
