409 4) Laydown yards for qualifying Hawai'i Historic Bridge Program projects must <br /> 410 be on existing paved areas or unpaved areas using protective matting. <br /> 411 D. Documenting Effect Findings <br /> 412 For projects qualifying as Tier 1 or 2 activities, Certified Project Managers will <br /> 413 complete a Compliance Form (Appendix C) documenting that the activities qualify <br /> 414 as Tier 1 and 2 activities under this Agreement. Documentation shall be maintained <br /> 415 in the project files and reported in accordance with Stipulation XI (Annual Review, <br /> 416 Auditing, and Reporting). <br /> 417 <br /> 418 For projects qualifying as Tier 3 activities, SOI Qualified Professionals shall make a <br /> 419 finding that the project results in No Adverse Effect on the Compliance Form <br /> 420 (Appendix C); HDOT Certified Project Managers shall maintain documentation in <br /> 421 the project files and report in accordance with Stipulation XI (Annual Review, <br /> 422 Auditing, and Reporting). <br /> 423 If a review by SOI Qualified Professional(s)determines that a project does not qualify <br /> 424 as for use of this Agreement, the Certified Project Manager shall utilize the <br /> 425 Compliance Form (Appendix C) to document that the project does not qualify for <br /> 426 processing under this Agreement, and that the project will be reviewed consistent <br /> 427 with 36 C.F.R. § 800. <br /> 428 <br /> 429 For projects when USACE is the Lead Federal Agency, the completed Compliance <br /> 430 Forms (Appendix C)will be submitted by HDOT or the Counties to the USACE with <br /> 431 the permit applications as evidence of the use of this Agreement. The USACE shall <br /> 432 receive project plans, specifications and/or other suitable documentation as needed <br /> 433 to verify the applicability of this Agreement. <br /> 434 HDOT shall notify the Signatories of the use of the Agreement on specific projects <br /> 435 in an annual report, as specified in Stipulation XI (Annual Review, Auditing, and <br /> 436 Reporting). <br /> 437 <br /> 438 E. Changes to the Scope of a Project <br /> 439 When changes to the scope, design, or implementation of a Hawai'i Historic Bridge <br /> 440 Program project occur post-Certification, the Certified Project Manager shall <br /> 441 evaluate the revised project and determine if the tier level of the project under this <br /> 442 Agreement still applies. If the project remains Tier 1 or Tier 2, the Certified Project <br /> 443 Manager shall prepare an updated Compliance Form (Appendix C). <br /> 444 The Certified Project Manager shall coordinate with SOI Qualified Professional(s) <br /> 445 when those changes result in new activities that meet Tier 3 or non-tiered activity <br /> 446 definitions. The SOI Qualified Professional(s) shall be provided with sufficient <br /> 447 information and time to allow for a complete reassessment of the modified project. <br /> 448 An updated Compliance Form (Appendix C) shall be prepared and included in the <br /> DRAFT FINAL <br /> Programmatic Agreement for the <br /> Hawai'i Historic Bridge Program 12 January 2, 2025 <br />
