487 HDOT/County will comply with the procedures in this Stipulation to the <br /> 488 extent possible, but the reviews may be conducted after the emergency work <br /> 489 is completed. <br /> 490 iv. For projects taking longer than 30 days for repair after the declaration of the <br /> 491 emergency by an appropriate authority, HDOT, on behalf of the applicable <br /> 492 Lead Federal Agency, will comply with the procedures in Stipulation VII. <br /> 493 HDOT, however, may request an extension of the period for the repair project <br /> 494 from the applicable Lead Federal Agency prior to the expiration of the 30 <br /> 495 days. <br /> 496 D. HDOT, on behalf of the applicable Lead Federal Agency, will provide notification <br /> 497 of an emergency action to SHPO within seven (7) days of the effective date of the <br /> 498 Agreement. Notification may be transmitted by email, HICRIS, other electronic <br /> 499 means, or by hand delivery, as agreed to by HDOT and SHPO. The notice will be <br /> 500 clearly and prominently marked as an emergency notification and will include an <br /> 501 explanation of how the action meets the requirements for emergency as defined <br /> 502 herein. The notice will also include a brief description of the eligibility and/or <br /> 503 significance of the historic bridge involved, the nature, effect, and anticipated effect <br /> 504 of the emergency action on the resources, and the anticipated time frame available <br /> 505 for comment. <br /> 506 E. Where USACE is the applicable Lead Federal Agency, it will follow 33 C.F.R. § <br /> 507 325.2(e)(4)in declaring an emergency as defined. USACE will comply with these <br /> 508 regulations in a manner that is consistent with the terms of this Stipulation. In <br /> 509 declaring an emergency, USACE will notify the Signatories consistent with <br /> 510 Stipulation XIII. <br /> 511 IX. POST-REVIEW AND UNEXPECTED EFFECTS <br /> 512 If a Hawai'i Historic Bridge Program project classified as a Tier 1, 2, or 3 activity under <br /> 513 this Agreement takes place on a bridge or structure on the Historic Bridge List(Attachment <br /> 514 1) and results in unexpected effects due to unknown conditions or other situations <br /> 515 encountered during construction, HDOT will cease the activity and reevaluate the <br /> 516 applicability of this Agreement. Reevaluation will use the processes described in <br /> 517 Stipulation VII.E ("Changes to the Scope of Project") or Stipulation VIII ("Emergency <br /> 518 Situations"). If the SOI Qualified Professional(s) reviewing the unexpected effect <br /> 519 concludes that the activity has or may possibly result in a finding of Adverse Effect,HDOT <br /> 520 shall carry out the requirements of 36. C.F.R. 800.13(b) (Discoveries without Prior <br /> 521 Planning). <br /> 522 X. IDENTIFICATION AND TREATMENT OF HUMAN REMAINS <br /> 523 A.
