525 B. In the event that human remains are identified during construction,the procedures for <br /> 526 the treatment of human remains shall be consistent with HAR § 13-300-40. <br /> 527 C. Human remains or funerary objects discovered on Federal lands shall be treated in <br /> 528 accordance with the Native American Graves Protection and Repatriation Act (25 <br /> 529 U.S.C. § 3001 et. Seq.). <br /> 530 D. When USACE is the Lead Federal Agency, nationwide permit General Condition 21 <br /> 531 "Discovery of Previously Unknown Remains and Artifacts" will apply. If any <br /> 532 previously unknown historic, cultural, or archeological remains and artifacts are <br /> 533 discovered while accomplishing the activity authorized by this permit, the District <br /> 534 Engineer must be notified of the finding. The District Engineer will initiate the <br /> 535 Federal, NHO, and State coordination required to determine if the items or remains <br /> 536 warrant a recovery effort or if the site is eligible for listing in the NHRP. <br /> 537 XI. ANNUAL REVIEW,AUDITING,AND REPORTING <br /> 538 A. Following the execution of this Agreement, until it expires or is terminated, HDOT <br /> 539 shall provide all parties to this Agreement a summary report detailing the work <br /> 540 performed under this Agreement on March 31 and September 30 of each year <br /> 541 pursuant to the terms of this Agreement. Such reports shall include: <br /> 542 1) Summary information on all Hawai'i Historic Bridge Program projects <br /> 543 processed under this Agreement; <br /> 544 2) Copies of all Compliance Forms (Appendix C) signed by the Certified Project <br /> 545 Manager or SOI Qualified Professional(s); <br /> 546 3) Concerns or problems with the Agreement; <br /> 547 4) Disputes and objections received during efforts to carry out the terms of this <br /> 548 Agreement. <br /> 549 B. If after twelve (12) months and/or the completion of two reports, whichever comes <br /> 550 later, the SHPO finds that the parties have successfully complied with the terms of <br /> 551 this Agreement, the reporting requirements under this part shall be annual, and due <br /> 552 each September 30. <br /> 553 C. Agreement Review Meeting: <br /> 554 Upon request of any Signatory, HDOT will covene a meeting to discuss functioning <br /> 555 of this Agreement within 60 days of the request. HDOT will be responsible for <br /> 556 providing notice of the meetings to the Signatories, and as appropriate, consulting <br /> 557 parties and preparing a meeting agenda, staffing, and conducting the meeting, and <br /> 558 preparing a meeting summary of discussions, issues, and concerns. The meeting <br /> 559 summary shall be provided no later than 30 days after the meeting and will be <br /> 560 distributed to all parties after the meeting has concluded. <br /> DRAFT FINAL <br /> Programmatic Agreement for the <br /> Hawai'i Historic Bridge Program 15 January 2, 2025 <br />
