109 STIPULATIONS <br /> 110 The Signatories shall ensure that the following measures are carried out: <br /> 111 I. PURPOSE,APPLICABILITY,AND SCOPE <br /> 112 A. This Agreement establishes the basis for review of individual Historic Bridge <br /> 113 Projects and sets forth the process by which the FHWA and USACE (Federal <br /> 114 Agencies, with the assistance of HDOT and the Counties will meet their respective <br /> 115 responsibilities under Section 106 of the NHPA for the Hawai'i Historic Bridge <br /> 116 Program. The objective of this Agreement is to make more efficient the methods by <br /> 117 which the parties review minor projects and routine undertakings that may affect <br /> 118 historic bridges. <br /> 119 <br /> 120 B. This Agreement applies only to historic bridges and structures included on the <br /> 121 Historic Bridge List (Attachment 1). Stipulation V sets out conditions for updating <br /> 122 the Historic Bridge List with new eligibility findings. <br /> 123 C. This Agreement applies only to the Tiered Activities for the Hawai'i Historic Bridge <br /> 124 Program ("Tiered Activities Matrix," Appendix A). <br /> 125 D. At any time, HDOT or the Counties, in consultation with and/or if requested by the <br /> 126 Federal Agencies may choose to conduct the Section 106 review for a Historic Bridge <br /> 127 Project by following the procedures in 36 C.F.R. §800 rather than by following the <br /> 128 procedures in this Agreement. <br /> 129 <br /> 130 II. AGENCY RESPONSIBILITIES FOR THE HAWAPI HISTORIC BRIDGE <br /> 131 PROGRAM <br /> 132 A. FHWA Responsibilities <br /> 133 Consistent with the requirements of 800.2(a)(1-4), FHWA remains responsible for <br /> 134 ensuring that the terms of this Agreement are carried out and for all findings and <br /> 135 determinations made pursuant to this Agreement by HDOT under the authority of <br /> 136 FHWA. FHWA shall be responsible for resolving disputes and objections pursuant <br /> 137 to Stipulation XVIII ("Dispute Resolution") of this Agreement. <br /> 138 B. USACE Responsibilities <br /> 139 The USACE issues permits for certain regulated activities associated with Historic <br /> 140 Bridge No Adverse Effect Projects (Tiered Activities, Appendix A).
