143 C. SHPO Responsibilities <br /> 144 The SHPO reflects the interests of the State and its citizens in the preservation of their <br /> 145 heritage. In accordance with 54 U.S.C. § 302303(b), 36 C.F.R. § 800, and this <br /> 146 Agreement,the SHPO will advise and assist FHWA and USACE in carrying out their <br /> 147 Section 106 responsibilities and cooperate with HDOT in the implementation of this <br /> 148 Agreement. <br /> 149 D. ACHP Responsibilities <br /> 150 1) The ACHP issues the regulations to implement Section 106 and shall provide <br /> 151 guidance and advice to the parties to this Agreement. <br /> 152 2) The ACHP shall be notified of findings of adverse effect by the applicable lead <br /> 153 federal agency and shall be invited to participate in resolving the adverse effect <br /> 154 of an undertaking in accordance with 36 CFR 800.6(a)(1). <br /> 155 3) The ACHP shall participate, in accordance with Stipulation XVIII ("Dispute <br /> 156 Resolution"), in the resolution of disputes that may occur through the <br /> 157 implementation of this Agreement. <br /> 158 E. HDOT Responsibilities <br /> 159 1) With respect to this Agreement, HDOT responsibilities shall be to complete <br /> 160 project reviews pursuant to Stipulation VII ("Project Review") resulting in <br /> 161 findings of No Adverse Effect or determinations that projects do not qualify as <br /> 162 a Tiered Activity covered by this Agreement. Non-qualifying projects shall be <br /> 163 subject to the Section 106 Process per 36 C.F.R. § 800.3 to 800.13. <br /> 164 <br /> 165 2) HDOT will initiate and complete project reviews using the procedures in 36 <br /> 166 C.F.R. §800 for any Program undertakings that will result in findings of <br /> 167 Adverse Effect on historic bridges or other types of historic properties not <br /> 168 covered by this Agreement. <br /> 169 3) HDOT shall oversee and coordinate with the Counties to ensure that the <br /> 170 provisions of this Agreement are utilized and implemented by project sponsors. <br /> 171 HDOT shall confirm that an undertaking is a Tiered Activity (Appendix A) and <br /> 172 shall ensure that project reviews are completed pursuant to Stipulation VII <br /> 173 ("Project Review")resulting in findings of No Adverse Effect or determinations <br /> 174 that projects do not qualify as Tiered Activities covered by this Agreement. <br /> 175 Non-qualifying projects shall be subject to the Section 106 Process per 36 <br /> 176 C.F.R. §800.3 to 800.13. <br /> 177 <br /> 178 4) HDOT is responsible for maintaining the Professional Qualification Standards <br /> 179 (Stipulation III)and Personnel Training(Stipulation IV)required to support this <br /> 180 Agreement. <br /> DRAFT FINAL <br /> Programmatic Agreement for the <br /> Hawai'i Historic Bridge Program 5 January 2, 2025 <br />
