RULE 2-2 LIQUOR CONTROL ADJUDICATION BOARD. There shall be a Liquor <br />Control Adjudication Board consisting of 5 members who shall be appointed by the <br />Mayor and confirmed by the Council in the manner prescribed in Section 13-4, of the <br />County Charter, County of Hawaii. The Liquor Control Adjudication Board shall <br />hear and determine all complaints regarding violations of the liquor control laws of <br />the State, or complaints regarding violations of rules and regulations established by <br />the Liquor Commission and impose such fines or punishment as may be provided by <br />law upon the conviction thereof. <br />In accordance with Chapter 281, Hawaii Revised Statutes, as amended, and the <br />Charter of the County of Hawaii, the Liquor Control Adjudication Board is granted <br />the authority to hear all matters involving a violation of the liquor laws and to take <br />appropriate action against a licensee in accordance with Section 281-91, Hawai`i <br />Revised Statutes, as amended, and the Charter of the County of Hawaii. The Board <br />shall be authorized to adopt its Rules and Regulations in accordance with the Charter <br />of the County of Hawaii. Any Rule or Decision and Order of the Board shall have <br />the force and effect of law. Violations of such Rule or Decision and Order shall be <br />subject to disciplinary action. <br />RULE 2-3 DIRECTOR OF THE DEPARTMENT OF LIQUOR CONTROL. The Director <br />of the Department of Liquor Control shall be appointed by the Commission and may <br />be removed by the Commission in accordance with the provisions of Section 7-3.4(a) <br />of the Hawaii County Charter. The Director of the Department of Liquor Control <br />shall: <br />A. Be the administrative head of the department. <br />B. Provide clerical and administrative services for and on behalf of the Commission <br />and the Board, including the submission of a budget for the operation of the <br />Department. <br />C. Investigate complaints regarding violations of the liquor control laws of the State <br />or complaints regarding violations of rules and regulations established by the <br />Commission and report such violations to the prosecuting officer of the County, <br />provided that the Director shall be authorized to subpoena any witnesses or <br />records for the purpose of an investigation where there is a cause to believe that a <br />violation of liquor laws has occurred. <br />D. Be authorized to enact emergency rules in the event of national, State or local <br />emergency, for the health, safety or welfare of the public or the protection of life <br />and property. Such emergency rule may be adopted without notice of hearing or <br />publication and shall be subject to the approval of the Mayor and shall be in effect <br />for the duration of the emergency. <br />E. Be authorized to designate a portion of fine monies collected for use in programs <br />to promote compliance to liquor laws. Such programs may include, but is not <br />limited to enforcement, public service announcements promoting responsible <br />drinking and driving, youth programs and education. <br />19 <br />
