Merit Appeals Board October 4, 2024 <br />Communication No. 24-13.01: Received On August 29, 2024, From Appellant, <br />Transmitting Documents Entitled "Representation And Correspondence." The Appellant <br />Requests The Following: 1) The Hearing Be Delayed Until The Appellant Can Obtain <br />Proper Legal Counsel; And 2) Merit Appeals Board Chair, Gabriella Cabanas, Be <br />Recused From Making Any Decisions Involving Appellants Appeal; And <br />Communication No. 24-13.02: Received On August 29, 2024, From Appellee Regarding <br />Appellee's Position Statement; Exhibits "A" — "H") (Executive Session: The Merit <br />Appeals Board Anticipates Convening One Or More Executive Meetings Regarding The <br />Above Matter, Pursuant To HRS Sections 92-4, 92-5(a)(2) And 92-5(a)(4), For The Purpose <br />Of Evaluating An Officer Or Employee Of The County Of Hawaii, Where The <br />Consideration Of Matters Affecting Privacy Will Be Involved And Consulting With The <br />Board's Attorney On Questions And Issues Pertaining To The Board's Powers, Duties, <br />Privileges, Immunities, And Liabilities. A 2/3 Vote Of The Members Present Pursuant To <br />HRS Section 92-4 Is Necessary To Hold An Executive Meeting) <br />CHR. CABANAS: Okay. We are now back in open session, having concluded our executive <br />session. It is now 9:34 a.m.. And I'd like to welcome Mr. Tony Enriquez to our Merit Appeals <br />Board meeting. <br />(At this time, Mr. Tony M. Enriquez, Appellant, appeared via Zoom.) <br />CHR. CABANAS: Good morning, Mr. Enriquez. <br />MALE SPEAKER: You're muted. <br />CHR. CABANAS: Good morning, Mr. Enriquez. This is Gabriella Cabanas — <br />MR. ENRIQUEZ: Good morning. <br />CHR. CABANAS: the Merit Appeals Board Chair. <br />Okay, so we have in the Hilo Council Chambers four Board members —Ms. Gay Mathews, our <br />Vice -Chair; Mr. Charlie Kunz and Ms. Suzi Bond; and sitting in via Zoom from Kona, is the <br />fifth Board member, Mr. David Wiseman. And appearing via Zoom from Oahu is our Legal <br />Counsel, Deputy Attorney General, Mr. James Halvorson. In the Chambers with us, also, is our <br />Human Resources Director, Ms. Sommer Tokihiro; our Secretary -Reporter, Ms. Glynis Yamada; <br />and Mr. Disher from the Office of the Corporation Counsel —he is the County's attorney for your <br />case. <br />Can you hear me loud and clear? <br />MR.
