Liquor Commission <br />Black Onyx Entertainment LLC <br />dba Black Onyx <br />Page 4 <br />Landlord submitted a Consent and Acknowledgment for Liquor License Application dated June <br />12, 2025 consenting that Tasmine Curenton, named in the Lease as the Tenant for the referenced <br />address of 202 Kamehameha Avenue, Hilo, Hawaii, may proceed with applying for a liquor <br />license with the County of Hawaii, Department of Liquor Control. Landlord also acknowledged <br />and recognized that Tasmine Curenton is the authorized representative of Black Onyx <br />Entertainment LLC, operating under the dba Black Onyx and is applying for a liquor license. <br />ZONING: Downtown Hilo Commercial District / State Land Use — Urban. <br />SURROUNDING AREA: Survey of the surrounding area reveals that there is one church, <br />Central Christian Church, and one school, Connections Public Charter School, located within <br />500 feet of the proposed licensed premises. <br />There are no liquor licenses with the same class located within 500 feet of the proposed licensed <br />premises. <br />At the present time, there are two (2) of the same class of liquor license being lawfully exercised <br />in the County of Hawaii. <br />DETERMING PROTESTS WITHIN 500 FEET OF A SCHOOL OR PLAYGROUND: <br />Section 281-39.5 of the Hawaii Revised Statutes, as amended, states in relevant part, "The <br />liquor commission... may deny or restrict the issuance of a liquor license for on -site sale and <br />consumption by the drink to any applicant whose establishment is or would be located within <br />five hundred feet of a public or private elementary, intermediate, or high school, or public <br />playground utilized extensively by minors, as determined by the liquor commission." <br />Section 281-39.5 of the Hawaii Revised Statutes, as amended, also states in relevant part, <br />"...that the liquor commission... shall deny the issuance of a liquor license if forty per cent of the <br />registered voters... owners and lessees of record of real estate and owners of record of shares in a <br />cooperative apartment within five hundred feet of the nearest point of the premises for which the <br />licensed is asked; have duly filed or caused to be filed their protests against granting the license." <br />PREVIOUS OPERATION AS A NON -LICENSEE: On or about November 10, 2024, our <br />Department received a tip that a business located at 202 Kamehameha Avenue in Hilo was <br />selling and serving liquor, including offering bottle service, without a liquor license. Upon <br />further investigation by the Department, including an undercover investigation, it was <br />determined that Applicant was selling and serving alcohol without a liquor license. <br />On November 27, 2024, the Department of Liquor Control delivered/issued Applicant a notice to <br />immediately cease and desist all liquor operations, including but not limited to the sale (selling, <br />serving, or furnishing) of liquor, to surrender its liquor inventory and appear before the Liquor <br />Commission on January 9, 2025. Approximately, twenty-six (26) bottles of liquor were removed <br />from the premises. <br />
