IMPORTANT INFORMATION REGARDING THE "COMPLAINT OF <br />MISCONDUCT"" FORM AND THE ROLE OF THE POLICE COMMISSION <br />ABOUT THE <br />POLICE COMMISSION -The <br />Commission was formalized by County Charter in 1969 in Section 7-2.2. -There <br />is one commissioner per voting district, appointed by the mayor and approved by <br />majority vote of the County Council. <br />Commissioners are unpaid volunteers and serve for a period of five years. -The <br />Commission has three major functions as per Charter: hiring of the Chief of Police, <br />reviewing the annual budget, and evaluating public concerns via the Complaint of <br />Misconduct form and testimony at monthly meetings. -The <br />Commission does not function as a jury but as an advisory group to the Police <br />Department while providing transparency to its functioning. <br />COMPLAINT <br />EVALUATION <br />Complaints are substantiated based on a preponderance of evidence with findings <br />of sufficient evidence tasked to the Department for resolution with monthly status <br />reporting. <br />- The <br />Commission will not accept complaints where the complainant is considering legal <br />action or is currently in litigation against the Department. -Commission <br />findings of insufficient evidence or sufficient evidence with Department <br />recommendations are not a legal basis for or against litigation. -Complaints <br />are also reviewed by the Department to include its Office of Professional <br />Standards (Internal Affairs). Even complaints with findings of insufficient evidence <br />are valuable to the Department in its efforts to always improve while following its <br />mandate to serve and protect. <br />Thank You, <br />The Hawaii County Police Commission <br />
