Forms are also available [state <br />locations]. [SUGGESTION: Add and reference a cover sheet or half sheet to the <br />form which outlines duties of the Commission and what the form and process <br />does and doesn't do. Complainants would be better informed on the process and <br />expectations. This would also support the audit finding of steps and criteria in <br />investigations. Idid arough draft of a cover sheet just before my term ended in <br />2019. It apparently wasn't pursued.] <br />[Add a new item (d) and move up <br />subsequent items by one letter. Replaced (d) now (e and soon.] <br />(d) Commission decisions are based on complaint forms and complainant <br />testimony at monthly meetings. Findings of sufficient evidence leading to <br />department recommendations are based on a preponderance of evidence, <br />however, findings of insufficient evidence may still lead to an associated <br />recommendation. The Commission encourages clarifying statements and <br />relevant information not covered in the complaint form. The Commission <br />reviews complaints and officers' written statements prior to the meeting. <br />Officers are strongly encouraged to attend meetings and provide statements. <br />Should aspects of statements need to be subsequently verified, the <br />Commission may hold over a determination to the next meeting. [NOTE: This <br />item partially addresses the audit finding of the need for more specifics and steps <br />in Commission investigations. The BURDEN OF PROOF text in RULE 6.
