Hawaii Police Commission <br />Regular Session Minutes <br />October 22, 2010 <br />Page 3 <br />• Commendations: Deputy Chief Ferreira reported receiving 13 commendations since <br />the last meeting. <br />• Other Departmental Activities: Deputy Chief Ferreira reported that he, the Chief, and <br />the Assistant Chiefs participated in the fundraiser "Walk a Mile in Her Shoes." <br />Deputy Chief Ferreira stated that they have not been officially asked to participate in <br />the APEC Conference on O'ahu. Planning is still in the works. Pre and post <br />expenditures will probably come out of their pockets. Commissioner Ono expressed <br />concern that heads of states will be attending pre and post conference. <br />EXECUTIVE SESSION <br />Commissioner Sumja moved to meet in executive session to consider discipline and <br />charges against officers or employees of the Hawaii Police Department where <br />consideration of matters affecting privacy will be involved and to consult with Corporation <br />Counsel on questions and issues pertaining to the commission's powers, duties, privileges, <br />immunities, and liabilities pursuant to HRS 92 -5 (2) (4) and the Hawaii County Charter <br />Section 13 -20 (b). Commissioner Victorine seconded. The motion carried with a <br />unanimous roll call vote. <br />Executive session convened at 9:52 a.m. <br />Regular session reconvened at 12:20 p.m. <br />ACTION ON EXECUTIVE SESSION MATTERS <br />• Complaint HPC 10 -23: Complainant made a complaint about the manner in which she <br />was arrested in 2008. The commission will only determine whether or not to accept the <br />complaint because it was received one year and nine months from the date of the <br />incident. Commissioner Victorine moved to decline acceptance because the complaint <br />did not meet the 90 -day rule for filing. Commissioner Ono seconded, and it carried <br />unanimously. <br />Complaint HPC 10 -27: Complainant alleged that an officer pulled him over without <br />just cause which made him feel threatened. Commissioner Victorine moved that there <br />was insufficient evidence to prove the complainant's allegations. Commissioner Ono <br />seconded, and it carried unanimously. <br />• Complaint HPC 10 -28: Complainant alleged that he has been humiliated when <br />making reports at the Kona police station and that an unidentified officer in an <br />unmarked car yelled at him. Commissioner Sumja moved that there was insufficient <br />evidence to prove the complainant's allegations. Commissioner Victorine seconded, <br />and it carried unanimously. <br />STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS — None. <br />
