Liquor Commission <br />Kanikapila Cafe LLC <br />dba l lale Kanikapila <br />Page 4 <br />Applicant would like to have live entertainment in the form of karaoke, a DJ, and/or a band <br />while open for business on varying nights. <br />LEASE AGREEMENT: This lease agreement was executed on December 3, 2025, by and <br />between Prestige Investments, LLC ("Lessor") and Kanikapila Cafe LLC ("Lessee"). <br />This lease shall be for a term of five years, commencing on December 3, 2025 and terminating <br />on December 3, 2030. <br />Provided Lessee is not in default, Lessee shall have the right to extend the initial term for three <br />(3) successive periods of five (5) years each, by giving written notice of such election to extend <br />to Lessor no less than six (6) months prior to the expiration of the Initial Term (or the then - <br />current Extension Term, as applicable). <br />ZONING: Downtown Hilo Commercial. <br />SURROUNDING AREA: Survey of the surrounding area reveals there is one church located <br />within 500 feet of the proposed licensed premises, Central Christian Church, and one school, <br />Connections Public Charter School, that is located within 500 feet of the proposed licensed <br />premises. <br />There are three (3) liquor licenses with the same class and kind located within 500 feet of the <br />proposed licensed premises: <br />JROG, LLC dba Jackie Rey's Ohana Grill Hilo: REST-G-882 <br />Hilo Sunrise LLC dba Moms Hilo: REST-G-837 <br />Hatch Enterprises Incorporated dba The Temple: REST-G-929 <br />At the present time there are 139 of the same class and 122 of the same kind of liquor licenses <br />being lawfully exercised in the County of Hawaii. <br />DETERMINE PROTESTS WITHIN 500 FEET OF A SCHOOL OR PLAYGROUND: <br />Section 2 81-3 9.5 of the Hawai ` i Revised Statutes, as amended, states in relevant part, "The <br />liquor commission... may deny or restrict the issuance of a liquor license for on -site sale and <br />consumption by the drink to any applicant whose establishment is or would be located within <br />five hundred feet of a public or private elementary, intermediate, or high school, or public <br />playground utilized extensively by minors, as determined by the liquor commission." <br />Section 281-39.5 of the Hawai` i Revised Statutes, as amended, also states in relevant part, <br />"...that the liquor commission... shall deny the issuance of a liquor license if forty per cent of the <br />registered voters ... owners and lessees of record of real estate and owners of record of shares in a <br />cooperative apartment within five hundred feet of the nearest point of the premises for which the <br />licensed is asked; have duly filed or caused to be filed their protests against granting the license." <br />
