Was that what it was? <br />SCHOEN: Correct. So basically the ordinance states that no letter, newsletters, <br />brochures, legislative summaries, or other mass mailings of material designed to support a <br />candidate's nomination may be circulated at public expense by an incumbent councilmember <br />within six months prior to the County election or after any member has filed nomination papers, <br />whichever comes first. <br />LUM: Okay. <br />SCHOEN: So that's the essence of the ordinance, and it also provides an administrative <br />fine not to exceed one thousand dollars for each violation that the Board of Ethics determines. <br />So this ordinance will amend our code of ethics. <br />CHAIR: Okay. <br />NICHOLSON: Can we get a copy of that with our next mail -out? <br />SCHOEN: Sure. <br />LUM: So the administrative fine is imposed by— <br />CHAIR: - -us. <br />SCHOEN: The administrative fine would be imposed by this Board, and that actually <br />relates to unfinished business item number 7b— <br />CHAIR: - -Why don't you just move right on, then. <br />SCHOEN: Okay, so we'll move on to that. <br />b. Report from counsel on the status of Council Bill 209, relating to the imposition of <br />administrative fines for violations of the County Code of Ethics (includes <br />Communication 2008 -42, an email from Lincoln Ashida, Corporation Counsel. <br />SCHOEN: Bill 209 also was heard on April ninth before the County Council, and it <br />passed second and final reading. That particular ordinance becomes effective upon this board <br />promulgating rules pursuant to H.R.S. Chapter 91 and Chapter 46 So basically this board has <br />to set up rules regarding its imposition of administrative fines.
