I think Mrs. <br />Lum was trying to ask you when this happened and how it happened, and when did you <br />become aware that Ms. Naeole referred to you as whacky. Could you answer that? <br />COLE: Yes, I could. How it happened, apparently, is I petitioned the District Court of <br />the Third Circuit an impeachment. The reason that I petitioned the actually, it was not <br />a petition, because there is no procedure in the County Charter for a petition, to petition, <br />because all petition forms are required to be presented to, or received from, the County <br />Clerk. The County of Hawai `i, the Corporation or the County of Hawai `i has admitted <br />it has no petitions in order to file for an impeachment. Therefore, I filed a complaint in <br />Federal Court or in the District Court, and the complaint was received by the court. <br />Had the court recognized my complaint as a petition under the separation of powers of <br />the constitutions of the state and the federal government, the court would have had to <br />send to the County Council Election Commission to verify that it was a petition, at which <br />point the Election Commission would have said you are lacking 199 signatures, you have <br />30 days to obtain them. Okay, that did not happen. The fact that it appeared before the <br />court the court does not have the legal authority to deny a petition. Only the legislative <br />body of the County has that authority. <br />CHAIR: Okay, how did the whacky comment come in? <br />COLE: The whacky came from the fact that I petitioned, and everybody says you have a <br />petition of one. It was not a petition, it was a complaint. The--Judge Nakamura, as you <br />will notice in the documentation that was submitted here earlier, appears to be in conflict <br />of interest and in support of organized corruption, because had my petition or <br />impeachment gone forward, it would have exposed Judge Wayne Metcalf, a classmate of <br />his, to the acts of judicial misconduct. <br />CHAIR: Okay, how was the whacky playing out there? <br />COLE: Well, basically it was just hey, it was crazy to submit a petition. Had Emily <br />Naeole given the opportunity to make clarification of her statements prior to me <br />submitting any documents - -she refused and in fact has refused all correspondence and <br />has disenfranchised numerous people.
