CHAIR: Yes. <br />SCHOEN: I believe the Board did provide sufficient notice of this hearing by posting the <br />agenda in an appropriate time period. This Board also provided Mr. Cole with notice <br />that the hearings would be held today, and so just based on those representations, I <br />believe the Board can proceed today. <br />COLE: Could you please read rule 3.4 for the record? <br />GENTRY: Is that appropriate excuse me, Mr. Chairman, is that appropriate to do <br />during public testimony, or should we wait till the item is called, and then if he has <br />motions and stuff to take up, we take it up under the petition item? <br />CHAIR: Okay. <br />GENTRY: Because this is public testimony. <br />CHAIR: Right. <br />COLE: And these are written statements for the public. <br />CHAIR: Okay. <br />LUM.• We can wait <br />CHAIR: Yeah, we can, but why don't we wait until we get to the minutes. <br />L UM: Okay. <br />CHAIR: All right, so that's it. You have public testimony. Thank you. <br />COLE: These are submitted do I give these to ? <br />(Mr. Cole handed his public testimony to the secretary.) <br />CHAIR: Okay, any other public testimony? Moving on to item 3, approval of minutes. <br />3. APPROVAL OF MINUTES <br />Minutes of the April 8, 2009, Regular Session. <br />Motion and vote: Ms. Gentry moved to accept the minutes, Ms. Lum seconded the <br />motion, and all members voted aye. <br />Minutes of the April 8, 2009, Executive Session. <br />E? <br />
