KERN: Okay, so that sounds agreeable on both sides then. Great. So with that, moving on to the next <br />element of this, we have before us a motion on behalf of the Intervenors to disqualify Commissioner <br />Wallace Ishibashi. We also received a joint statement of position of Hu Honua and the County Planning <br />Department on the motion to disqualify. The joint statement of position does not require the <br />Commission’s actions; and I believe the motion by the Intervenors may be moot. But I think we should <br />act on the Intervenor’s motion nonetheless. So I’m willing to entertain a motion. And the motion is <br />basically either to deny the disqualification of Commissioner Ishibashi or to approve that. It is now <br />somewhat of a moot point since Commissioner Ishibashi has recused himself. <br /> <br />MECKLENBURG: Yeah. <br /> <br />KERN: Julie. <br /> <br />MECKLENBURG: Technically the motion is still before the Commission. <br /> <br />KERN: Yes. <br /> <br />MECKLENBURG: So the motion would be to deny -. <br /> <br />KERN: Or accept. <br /> <br />MECKLENBURG: I’m sorry, the Commission’s motion would be to deny the motion for <br />disqualification as moot, presumably, unless any of the Commissioners feel that any portion of that <br />motion should survive. <br /> <br />KERN: So with that I’m willing to entertain a motion. <br /> <br />DOMINGO: Mr. Chairman? <br /> <br />KERN: Yes. <br /> <br />DOMINGO: I move that we declare that the Intervenor’s motion is moot because we’ve had a letter, a <br />statement made by Mr. Ishibashi with regards to his recusing himself from discussions and participation. <br /> <br /> <br />KERN: So, clarification -. The motion or the, yes, the motion that we have before us, you’re looking <br />to deny that, is that correct, the disqualification? <br /> <br />DOMINGO: Yes. <br /> <br />KERN: Okay, is there a second? Is there a second on that motion? If there is no second, then the <br />motion will fail.
