• a physical or mental impairment that substantially limits one or <br />more of the major life activities of such individual (an impairment <br />that is episodic or in remission is a disability if it would substantially <br />limit a major life activity when active); <br />• a record of such impairment; or <br />• being regarded as having such an impairment.3 <br />Note: Some impairments virtually always constitute a disability including, <br />but not limited to, epilepsy, diabetes, cancer, HIV infection, bipolar <br />disorder, deafness, blindness, intellectual disability (formerly known as <br />mental retardation), partially or completely missing limbs, autism, <br />obsessive compulsive disorder, cerebral palsy, multiple sclerosis, muscular <br />dystrophy, etc. <br />"Essential functions" mean the fundamental job duties of the employment <br />position the individual with a disability holds or desires. The term "essential <br />functions" does not include the marginal functions of the position.4 <br />"Expedited request" means a request for accommodation that must be <br />processed quickly so the individual with a disability does not lose an <br />opportunity to participate because the accommodation is delayed, for <br />example, arranging for a sign language interpreter to sign during an <br />employment interview for a job applicant who is deaf or arranging a <br />meeting in an accessible room so an employee with a mobility <br />impairment can attend. <br />"Extenuating circumstances" means factors that delay the processing of <br />an accommodation request that could not have reasonably been <br />anticipated or avoided in advance of the request for accommodation. <br />"Interactive process" means a good faith, flexible communication process <br />between an individual requesting a reasonable accommodation and the <br />decision maker to determine the appropriate accommodation. Although <br />this process is described in terms of accommodations that enable the <br />individual with a disability to perform the essential functions of the position <br />held or desired, it is equally applicable to accommodations involving the <br />job application process, training and special events, and to <br />accommodations that enable the individual with a disability to enjoy <br />equal benefits and privileges of employment. The interactive process <br />requires a decision maker to use the following problem -solving approach: <br />• analyze the particular job involved and determine its purpose and <br />essential functions; <br />• consult with the individual with a disability to ascertain the precise <br />job -related limitations imposed by the individual's impairment(s) <br />3 <br />
