MR. MELROSE: That section of that Bill refers to the need to take an action on any Alternate <br />Plan, and these are not technically Alternate Plans, so you are right, Joe. <br /> <br />MR. CARVALHO: Well, we need to vote, so letÓs just vote and get it over with. <br /> <br />CHR. SIRACUSA <br />: If we didnÓt vote to reject them, they would be up to go out for Public <br />Hearing, so it seems like we do have to make a decision. <br /> <br />MS. POINDEXTER: Jamae is here, so I wonder if we should just get a point of clarification? <br /> <br />JAMAE KAWAUCHI <br />(At this time Jamae Kawauchi, County Clerk, came forward to address members of the Commission.) <br /> <br />MS. KAWAUCHI: How can I help you? <br /> <br />MR. MELROSE <br />: The question is, we know by the Bill that we need to specifically act on any <br />Alternate Plan, make a specific action and a justification. Since these were ones presented for us <br />for discussion purposes from the Elections Office, do we need to take similar action on each plan <br />that we choose not to move forward with? <br />MS. KAWAUCHI <br />: You might want to also consult with your attorney; I believe Kyle Chang is <br />here from Corporation CounselÓs office, because you are asking for an interpretation of a County <br />Code provision. I will share with you, Commissioner Melrose, that yes, the way I read the Code, <br />I do see that for Alternate Plans there is a phrase that is used that is called, Ðjust cause.Ñ So, you <br />would have to at least provide an explanation on decision making concerning the plans. You <br />may want to adopt a process that is uniform for all the plans. But, the Code itself, just the plain <br />reading of it, I donÓt see anything that talks about a process of elimination for plans prepared at <br />your direction, by the Elections Office. <br /> <br />CHR. SIRACUSA: We somehow have to have a process to eliminate any Elections Office Plans <br />that we choose. <br />MS. KAWAUCHI: You would probably want to have some process outlined for yourselves; but <br />again, I would defer to your Corporation Counsel on the legality of it. From an organizational <br />standpoint, having a process in place that covers all the plans will probably help you. That way, <br />you donÓt have too many different types of decision-making for different kinds of plans that are <br />drafted.
