time is up. I will be around if you need to talk about this. I wanted the community and the <br />council to see this plan, thank you. <br />CHR. SIRACUSA: Thank you Brenda. Are you aware that your map has some major <br />connectivity issues in District 5? For example, Kalapana, Black Sands Subdivision and <br />Kaohe Homesteads, cannot access other parts of their district because of where you put the <br />District 4 boundary. <br />MS. FORD: You know that district better than me; I said this plan needs to be tweaked; it <br />needs to be tweaked. I still think it eliminates the worst problems of Plan_40 and Plan—A, <br />but it still needs to be tweaked. I rely on all of you to do that. <br />CHR. SIRACUSA: That is our job. <br />MR. MELROSE: I have a question. Thank you, Brenda. I appreciate your work on this. <br />You know, in the Bill that you crafted to design this process, you have a provision in the <br />Bill that says that places that are growing faster need to be accommodated. The fastest <br />growing districts, in your plan, are actually at the highest level of the variation. So, I think <br />that that concept is a struggle for us; we have always struggled with that. I think we ought <br />to suggest some amendments to your Bill when we get through actually exercising it; <br />because this kind of stuff makes it very hard for us. <br />MS. FORD: It's correct, I personally don't think the Bill needs to be changed; the <br />Ordinance, now it is an Ordinance. You have an out, as you all know. And the out is that <br />if you choose not to use one of the criteria, all you need to do is put it in your final plan and <br />explain why you didn't use it. You have an out. But, I wanted the Commission to consider <br />the high growth areas and try to get the lowest populations. Unfortunately, what we have <br />heard from communities all around the island is, "Keep the communities of interest <br />together." If that is going to become your top priority, there is no problem with that. Just <br />justify it in your final plan, and you are good to go. Puna has made it very clear that they <br />want two districts, which they certainly deserve, and they want to keep as much of Puna <br />together as they possibly can. My caution, and I put it in my testimony, is don't go over <br />the 10 %, don't go over the 4.99 %, because that will make your plan voidable on its face at <br />the U. S. Supreme Court. You can do this. I know you can do this. I know where some <br />tweaking needs to happen, and representatives from Puna and wherever, you know where it <br />needs to be tweaked. The problem is you have got to get rid of the worst problems, and <br />that is what this plan is trying to do; get rid of the worst problems. You can justify what <br />you need to do in a court of law, if it's in your final plan. This is what we chose as a more <br />important criteria than criteria x. I don't think the Ordinance needs to be changed, you just <br />need to do your job in your final report, and you can do it. <br />MR. MELROSE: One more question. Can you just explain where is Puako in your plan? <br />MS. FORD: Puako, in my plan, is not with Kohala. I think it is a problem, and I think that <br />needs to be tweaked. But at this point, I left it out just to get numbers. You need to do <br />something with that. Thank you. <br />23 <br />
