CHR. SIRACUSA: Did I mis -state that? <br />MR. KAHAWAIOLA`A: No, you didn't, I only wanted to make a point of clarification; we had <br />no Ordinance like we do now. <br />CHR. SIRACUSA: Got you. <br />MR. CHANG: Yes, Madam Chair, unfortunately, I haven't read that Supreme Court case, but <br />based on what you are telling me now, and without me actually researching the issue, I think that <br />the Ordinance will come into play if this were to go to court again. It does set a precedent that <br />keeping communities of interest together, that is a factor. But again, another factor that the court <br />would look at if this were to become a law suit would be the Ordinance itself, as well. <br />CHR. SIRACUSA: Anybody else? Okay, let's go on now with our review and discussion of <br />redistricting plans. We have the most recent one that Margaret Wille submitted to look at and we <br />have one that Mike Middlesworth submitted to look at. Do we want to get Shyla up here now? <br />Shyla, if you would. <br />MR. MELROSE: Point of clarification; I want to make sure that we didn't miss one in between <br />what has been the re -done and re -done Plan 40 and what is now Plan 46. Did we look at all of <br />the other ones that have come in and have been numbered? Have we done that already? I just <br />want to confirm that, like Plan 41, 42, 43, 44, 45. <br />MR. MIDDLESWORTH: There are no Plans 41 — 46. <br />MR. MELROSE: Did they give Plan -40 a new number every time it was amended? <br />CHR. SIRACUSA: No. <br />MR. MELROSE: Can somebody confirm how that took place so that we are certain that there are <br />not a series of plans between 40 and 46 that are somehow-- - <br />CHR. SIRACUSA: I think Karen needs to come forward, because she was the one who was <br />receiving them when they were submitted. <br />MR. KAHAWAI OLA `A : That's why I'm getting a little bit confused with the term submitted. <br />We cut off a submission time and I keep hearing you say this plan that was submitted. So we <br />need to be very clear, we cut off submissions. <br />MS. POINDEXTER: I would like to see them. I know they have been sent to me, but it's harder. <br />It's easier to view them here when we have the zooming in and looking at all of that. <br />MS. EOFF: Thank you. My understanding is that at our last meeting in Kona we reviewed all of <br />the plans that were submitted by the deadline of September 15, 2011. Those were called up to <br />Plan -3 9. Then at that meeting, because of the issue with Plan -3 9, we did do some work on it and <br />then re -named that a Plan -40, which is a Commission's work in progress.
