ORDER OF THE DAY <br />COMM. 45: REVIEW AND DISCUSSION OF REDISTRICTING PLANS /MAPS <br />From Commission Chair, Rene Siracusa, dated October 14, 2011, requesting the <br />Commission's review and discussion of Redistricting Plans /Maps that have been <br />submitted; continue the formal process for elimination of Plans; and begin creating the <br />Commission's "Draft Plan." The Commission will take into consideration feedback <br />from the nine Public Hearings held between October 1, 2011 and October 20, 2011. <br />CHR. SIRACUSA: Do I have a motion to close file? <br />Mr. Middlesworth moved to close file on <br />COMM. 45. Seconded by Mr. Melrose. <br />CHR. SIRACUSA: Does anyone have any ideas on where they would like to start? <br />MS. UGALDE: May I ask a question of our attorney? It was brought up by a number of people <br />at different district meetings about the different rules that we have to work under. The deviation <br />seems to somehow be the most important, but there is the road connectivity, there are the <br />communities of interest. At one of those meetings I talked with Mike Udovic and got the <br />impression that what he said was that deviation was far more important than road connectivity I <br />need a legal opinion on if some of these rules are more important than others. <br />KYLE CHANG <br />(At this time Deputy Corporation Counsel Kyle Chang came forward to address members of the <br />Commission.) <br />MR. CHANG: Good morning madam Chair and members of the Commission, Kyle Chang, <br />Deputy Corporation Counsel. In looking at the Ordinance - -- <br />CHR. SIRACUSA: While you are looking, can I make a comment on something that sort of <br />relates to the same thing? That is, in looking through the rules, that some of the points, like <br />point number eight, say, "where practicable" and others don't say "where practicable," they <br />say "shall," not even "may." So is that where we take our cue? <br />MR. CHANG: That would be correct. Where it says, "shall" that would be stronger than <br />"may" or "where practicable." <br />MR. KANUHA: I'll go along with that. The "community of interest" is one of the biggest <br />things that the community brought up was they want to keep the communities of interest <br />together, but that is one of the points where it says, "if practicable." But the other point where <br />it says, "district shall be contiguous to the council district and be reachable by roads internal <br />to the council district," that is the one that says, "shall," and not, "if practicable." That was a <br />point that a lot of people said we should leave behind and shouldn't really consider too much, <br />0 <br />
