4-13Requests for Subpoenas <br />(a) Subpoena of a Witness. Any request for the issuance of a subpoena, requiring the <br />attendance of a witness for the purpose of taking oral testimony before the <br />Commission, shall be in writing and shall state the reasons why the testimony of <br />the witness is believed to be material and relevant to the issues involved. Only a <br />party or a member of the Commission may request the issuance of a subpoena. <br />(b) Subpoena of Documents. Any request for the issuance of a subpoena for the <br />production of documents or records shall be in writing; shall state the name of the <br />person who is to produce such documents or records; shall specify the particular <br />document or record, or part thereof, desired to be produced; and shall state the <br />reasons why the production thereof is believed to be material and relevant to the <br />issues involved. <br />(c) Time for Filing. A request for the issuance of a subpoena under this section shall <br />be valid only if it is physically received by the Commission no later than five <br />working days before the date of the hearing at which the subpoenaed witness is to <br />testify or documents are to be produced. The names of those for whom subpoenas <br />have been issued, and any returns of the service of said subpoenas, shall be <br />available upon request to the public at the office of the Planning Department. <br />(d) Who May Issue A Subpoena. A subpoena may be issued by the chairperson of <br />the Commission, the presiding officer, or a Commission member so authorized by <br />the Commission. No subpoena shall be issued unless the party requesting the <br />subpoena has complied with this section and gives the name and address of the <br />desired witness. Signed and sealed blank subpoenas will not be issued to anyone. <br />The name and address of the witness shall be inserted in the original subpoena, a <br />copy of which shall be filed in the proceeding. The subpoena shall show at whose <br />instance the subpoena is issued. <br />(e) Fees and Mileage. Any witness summoned shall be paid the same fees and <br />mileage as are paid to witnesses in the circuit court of the State of Hawai‘i, and <br />such fees and mileage shall be paid by the party at whose request the witness <br />appears. <br />(f) Oath. Each witness shall be placed under oath or affirmation prior to testifying. <br />(g) Written Request to Quash. Any party may bring a written request to quash any <br />subpoena issued, pursuant to this section, prior to the next scheduled meeting of <br />the Commission. Any such written request may be granted if the subpoena is <br />unreasonable or oppressive or may be denied or denied upon condition that the <br />requestor of the subpoena advance the reasonable cost of producing any requested <br />book, paper, document or tangible thing. <br />4-14Consolidation <br />The Commission, upon its own initiative or upon written request, may consolidate for <br />hearing or for other purposes, or may contemporaneously consider, two or more <br />proceedings which involve substantially the same parties or issues which are the same or <br />4-5 <br /> <br />
