indicated – the Central Federal Lands. We are required to notify the Central Federal Lands, which <br />is responsible for the Saddle Road project. We expect them to not be around after two or three <br />years, and so we wanted add in the last sentence, or the last, so we need to coordinate with the <br />military, with the Mauna Kea Observatory and, if applicable, the Federal Central Lands. So as long <br />as they are around, we notify them; once the project is done, we don’t want to have to notify them <br />of a project that they are not involved in. So, again, just real technical, not a big deal. Condition <br />11, this is respect to the liquor license. The condition now requires us to get a liquor license, and so <br />we just want to add flexibility that if we propose to serve alcohol, then we need to do it; but <br />otherwise, if we don’t get a liquor license, we are in violation of the conditions of approval. And <br />lastly, similar to the other, the Fire Department, the solid waste management plan that, you know, <br />again, we are, we need to do the initial plan, no question about that, but not on an ongoing basis; <br />once we have the basic plan set, then we don’t expect the basic solid waste issues to change, since <br />it’s basically going to be collecting and taking non-recyclables to the landfill. <br /> <br />GIFFIN: Commissioners, any questions of Bill Moore regarding the proposed changes to <br />Conditions 2, 4, 5, 11 and 12? Correct, Bill? <br /> <br />MOORE: And the suggested changes to 3 and 6 as well, which are not (inaudible). Condition 3 would be adding in consultation with the Police and the Fire <br />Departments. <br /> <br />GIFFIN: Correct, correct, sorry, yes. <br /> <br />MOORE: And 6, Condition 6 is adding “if applicable” with respect to notification of the Central <br />Federal Lands. <br /> <br />GIFFIN: Commissioners, any questions? Daryn, do you have wording that you want to, you would <br />like to state regarding these proposed changes? <br /> <br />ARAI: We have no objections to the changes that were included in the handout that the applicant’s <br />representative provided, as well as the clarification just mentioned regarding Conditions No. 3 and <br />6. In response to the submittal, we have no objections, but we would like to offer two additional <br />conditions, Conditions No. 14 and 15 that will replace the current 14 and 15 in your <br />recommendation report, I’m sorry, it will end up renumbering the current Conditions 14 and 15 in <br />your recommendation report. But 14 does speak to the complaint protocols in case, you know, the <br />applicant does receive a complaint, it must be forwarded to the Planning Department and the <br />Department will investigate, and if necessary, could result in revocation of the permit. At least, the <br />revocation action will be brought to you. Condition No. 15 is just making sure that the applicant <br />holds to the representations made before the Planning Commission. <br /> <br />I should note that there was discussion about the size of the facility, and I just want to make it clear, <br />and for the record, that the project site is about 14.5 acres; the reason is because anything greater <br />than 15 acres requires this action to go before the state Land Use Commission.
