Rodney & Lorrie Diamond <br />Application for Special Permit TMK (3) 1- 5- 017:112 <br />The subject property is 1 acre in sire. The area under consideration for a Special Use Permit is 0.43 acre. <br />It is presently not in agricultural use. Development of the subject property will not have a significant <br />adverse effect on the County's agricultural land inventory. It is submitted that the proposed use is an <br />unusual and reasonable use of lands situated within the Agricultural District and will not be contrary to <br />the objectives of Chapter 205 HRS, as amended. <br />205A HRS - Coastal Zone Management <br />The proposed use of the subject property is not contrary to the objectives sought to be accomplished by <br />Chapter 205A, Hawaii Revised Statutes, relating to the coastal zone management program. <br />The subject property is located 4.03 miles from the nearest shoreline. The property is located well <br />outside of the Special Management Area and tsunami evacuation zone. <br />The property will have no impact on coastal ecosystems or marine and coastal resources. The property <br />will not be affected by any coastal hazards or beach erosion. <br />There is no designated public access to the mountain or shoreline areas over the property. The <br />proposed use of the subject property will not restrict public access to cultural, historic, scenic, or open <br />space areas. <br />The coastal view plane is not visible from the subject property. The proposed use of the property will <br />not obstruct the public view plane of coastal areas or mountains. <br />Desired Use's Affect on Surrounding Properties <br />The desired use of the subject property will not have an adverse affect on the surrounding properties. <br />We have been in business at this location since 2004. In the years we've been at this location there has <br />never been a complaint. The subject property is bounded on all sides by a 6 ft. high privacy fence. The <br />activities proposed for the subject property are mostly passive in nature - parking and storage. The <br />proposed routine maintenance and repair work to be performed is not noisy, smelly, smoky nor dusty, <br />and will occur only during the proposed working hours of 8:00AM — 5:00PM, Monday through Friday. <br />Unreasonable Burden on Public Agencies <br />The desired use of the subject property will not unreasonably burden public agencies to provide roads <br />and streets, sewers, water, drainage, school improvements, and police and fire protection. As stated <br />previously, the subject property is self sufficient with respect to electricity, water, and sewerage. The <br />low volume of traffic to and from the subject property will not place an undue burden on the existing <br />access roads. No school -age children reside at the subject property. A fire suppression system is being <br />designed and will be installed at the subject property with approval of the special use permit. By <br />parking the drilling and farm vehicles on the subject property, a more secure location is provided for <br />their storage, reducing the need for police protection of the equipment if stored in an unoccupied off - <br />site location. <br />Unusual Conditions, Trends, and Needs Have Arisen Since the District Boundaries and <br />Regulations were Established <br />Due to increased population in the Puna area, there are many homes that are underserved with regards <br />to water supply. Most homes in Puna rely on rainwater catchment for their household water needs. <br />This is a water source of questionable sanitation and reliability, especially in times of low rainfall. There <br />are no plans for substantial expansion of the County of Hawaii.. Department of water Supply's service to <br />the Puna area. Private wells are a viable and reliable alternative to rainwater catchment. Private wells <br />Page 8 <br />
