Application for Special Permit <br />Rodney & Lorrie Diamond <br />TMK (3) 1- 5- 017:112 <br />without returning to the subject property in the interim. when there are no active jobs in progress, <br />drilling equipment will be parked on the subject property for days at a time. <br />Deliveries to the subject property include occasional FedEx or UPS deliveries once or twice a week, fuel <br />deliveries once every six months, and a 40' container of drilling supplies from the mainland once a year, <br />if needed. The business flatbed support truck is used to transport sand and gravel to be the remote job <br />sites. Extra sand and gravel not used on a job is stored on the subject property in small quantities - less <br />than two tons of gravel and sand at any given time. <br />Transport of farming equipment to /from the oil palm farm occurs one or two times a month. <br />As stated previously, the subject property will not be used as a retail or wholesale outlet. Business at the <br />subject property is done over the phone and by email. Items purchased by clients are delivered to their <br />property. Clients will not be coming to the subject property to receive purchased items. <br />Availability of Utilities <br />Metered electricity, telephone, and internet connectivity are available to the subject property. However, <br />electric demand for the residence and subject property is supplied by an onsite 10kw photovoltaic <br />system. Water demand is supplied by an onsite private well. <br />There is no wastewater service available to the subject property. The property has an existing cesspool <br />that serves the residence only. The other structures on the subject property do not have plumbing, and <br />are not connected to the cesspool. Because the existing cesspool only serves one residence with two <br />full time residents the cesspool is not classified as a high capacity cesspool by the State of Hawaii <br />Department of Health and the Environmental Protection Agency (EPA). <br />Grounds for Special Permit <br />The granting of this request would promote the effectiveness and objectives of Chapter 205, <br />Hawaii Revised Statutes, as amended. <br />205 HRS <br />The proposed use is an unusual and reasonable use of land situated within the State Land Use <br />Agricultural District and would promote the effectiveness and objectives of Chapter205, Hawaii Revised <br />Statutes, as amended. <br />In recognizing that lands within the agricultural districts might not be best suited for agricultural <br />activities and yet classified as such, and in recognition that certain types of uses might not best strictly <br />agricultural in nature, yet reasonable in such districts, the legislature has provided for the Special Permit <br />process to allow certain unusual and reasonable uses within the Agricultural District. In addition, the <br />State Land Use law and Regulations are intended to preserve, protect, and encourage the development <br />of lands in the State for those uses to which they are best suited in the interest of the public health and <br />welfare of the people of the State of Hawaii. In the case of the Agricultural District, the intent is to <br />preserve or keep lands of high agricultural potential in agricultural use. <br />The land on which the subject property is located is classified as "E" or "Very Poor" for agricultural <br />productivity by the Land Study Bureau and unclassified by the Agricultural Lands of Importance to the <br />State of Hawaii (ALISH) Map. <br />Page 7 <br />
