HAWAII COUNTY ENVIRONMENTAL MANAGEMENT COMMISSION <br /> RULES OF PRACTICE AND PROCEDURE <br /> PART 1. GENERAL RULES <br /> 1-1 Purpose. <br /> These rules govern the practice and procedure before the Environmental Management <br /> Commission of the County of Hawai'i. <br /> 1-2 Construction of Rules. <br /> (a) Just and Efficient Construction. These rules shall be construed to secure the just and <br /> efficient determination of every proceeding. <br /> (b) Rules to be Read in Conjunction. The rules set forth in Parts 1, 2, 3 and 4 of these <br /> Rules of Practice and Procedure are applicable to all proceedings conducted before <br /> the Commission and should be read in conjunction with the part governing the <br /> particular proceeding. <br /> (c) Conflicting Rules. When there is a conflict between a general rule in Parts 1, 2, 3 or <br /> 4 and a special rule in another part,the special rule shall govern. <br /> 1-3 Definitions. <br /> As used in these rules, except as otherwise required by context: <br /> (1) "Agency" means any agency,board, commission, department or officer of the county <br /> or state government, including the Commission. <br /> (2) "Chairperson" means the chairperson of the Environmental Management <br /> Commission of the County of Hawai'i. <br /> (3) "Charter" means the Hawai'i County Charter. <br /> (4) "Code" means the Hawai'i County Code. <br /> (5) "Commission" means the Environmental Management Commission of the County of <br /> Hawai'i. <br /> (6) "Director" means the Director of the Department of Environmental Management of <br /> the County of Hawai'i or the Director's duly authorized representative. <br /> (7) "Intervenor" means a person who petitions to intervene in a contested case <br /> proceeding and is admitted as a party. <br /> 7-1 <br />
