(8) "Meeting" means the convening of the Commission for which a quorum is required <br /> in order to make a decision or to deliberate toward a decision upon a matter over <br /> which the Commission has supervision, control,jurisdiction, or advisory power. <br /> (9) "Party" means any person or agency named or admitted as a party or properly seeking <br /> and entitled as of right to be admitted as a party in a proceeding. <br /> (10) "Person" means any individual, partnership, firm, association,trust, estate, <br /> corporation, or other legal entity,whether or not incorporated, including <br /> governmental agencies. <br /> (11) "Proceeding" means any matter that is brought before the Commission in which it <br /> has jurisdiction, including but not limited to: <br /> (A) Appeals from the actions of the Director. <br /> (B) Adoption, amendment, or repeal of any rule of the Commission. <br /> 1-4 The Commission. <br /> (a) Office. The office of the Commission is at Hilo, Hawai'i. <br /> (b) Communications. Any communication to the Commission shall be addressed to the <br /> Environmental Management Commission of the County of Hawai'i,Department of <br /> Environmental Management, County Building, 25 Aupuni Street,Hilo, Hawaii <br /> 96720,unless otherwise directed. <br /> (c) Chairperson;vice-chairperson. A Chairperson and a Vice-chairperson or Co- <br /> Chairpersons shall be elected from the Commission members. The vice-chairperson <br /> shall perform all the duties of the chairperson during the absence of the chairperson. <br /> If Co-Chairpersons are elected, duties and powers of the Chairperson/Vice- <br /> Chairperson and any references within these rules shall treat the Chairperson/Vice- <br /> Chairperson and Co-Chairpersons synonymously. <br /> 1-5 Meetings <br /> (a) Regular Meetings. Regular meetings shall be held on a monthly basis on the fourth <br /> Wednesday and shall alternate between Hilo and Kona,unless otherwise specified by <br /> the Commission. <br /> (b) Special Meetings. Special meetings of the Commission for the transaction of its <br /> business may be held at any time and place as scheduled by the Commission. <br /> (c) Notice of Regular and Special Meetings. <br /> (1) The Commission shall give written public notice of any regular or special <br /> meeting. The notice shall include an agenda which lists all of the items to be <br /> considered at the forthcoming meeting,the date,time, and place of the <br /> meeting. <br /> 7-2 <br />
