Communication No. 2012 -57.2 <br />April 7, 2012: Email submitted by complainant with five (5) pictures attached <br />showing the farmer's market activity held on April 7, 2012 in violation of the <br />Cease and Desist Order. <br />April 14, 2012: Email submitted by complainant informing the Planning <br />Department that the farmer's market was held on Saturday, April 14, 2012 at <br />SPACE in violation of the Cease and Desist Order. <br />Based on the requirements of the law to protect the confidentiality of complaints, the <br />complainant's personal information have been redacted. (Planning Department <br />Exhibit 7 — Complaints Received Regarding SPACE from January 2010 until the <br />Present) <br />CHONOLOGICAL TIMELINE OF ACTIONS BY PLANNING DEPARTMENT <br />9. March 1, 2010: A Notice of Non - Compliance of Conditions of Special <br />Permit No. 1122 issued by the Planning Department to Graham Ellis of SPACE. This <br />was after an investigation was conducted by Planning Department staff and violations <br />of conditions of Special Permit No. 1122 were confirmed based on complaints <br />received, site inspections and research. The Notice found non - compliance with 4 <br />conditions of the Special Permit and ordered the applicant to take certain corrective <br />action. (Planning Department Exhibit 8 — Letter Dated March 1, 2010 from the <br />Planning Department) <br />10. March 9, 2010: A letter was submitted by Graham Ellis of SPACE in response to <br />the listed corrective action in the Notice of Non - Compliance to "Provide <br />documentation that all corrective action has been completed as stated above by March <br />10, 2010 to the Planning Department." (Planning Department Exhibit 9 — Letter <br />Dated March 9, 2010 from Ellis) <br />11. March 12, 2010: On March 12, 2010, a meeting was conducted at the Planning <br />Department with SPACE representatives and the Planning Director to discuss <br />questions the applicant had regarding the cease and desist order. In summary, the <br />Planning Director allowed the farmer's market held on Saturdays and the bazaar held <br />on Wednesday nights to continue temporarily while SPACE representatives prepare <br />an amendment to Special Permit No. 1122. The Planning Director allowed these uses <br />to continue temporarily so that it would not affect people's income while the <br />
