people should have to have a permit for it. And so the noise that you would be generating from ag <br />tourism is a different kind of noise, believe me, because I’ve experienced it, than you experience <br />from ag. I have always said the noise rules are lacking in our county across the board. So I agree <br />that there needs to be, that really needs to be addressed. But I think that when you look at Cory’s <br />list, and this is not Cory’s list, this is a list like, once again, that came from a lot of different <br />testimonies, that more stringent standards allow the neighbors to be able to go to the County and say <br />this specifically is happening. You can take photos, I mean, I took photos of people doing what <br />they are doing. And, yes, if you are not allowed to go on private property, I mean, I can’t believe <br />that, I mean, I can believe it, but if somebody is beating their children, the, you know, the police can <br />come in and stop that even though, you know -. So I just think that there, I hear what you are <br />saying, Bobby Jean, and that makes me even more concerned that if we have this legislation, and <br />again, the number of people is huge on this because it’s easy to tell if there’s 20 or 30 people at a <br />place, but who can tell if it’s 200 or 350 or, I mean, all that you know is it’s a lot. <br /> <br />LEITHEAD TODD: What if you made a requirement that you in addition to this, and I’m not <br />talking about going through like a special use permit because it’s a permitted use under State Law, <br />but something like you have to file at least a permit application with the County, so that if you’ve <br />got activity going on next door, you can make a call and find out whether somebody has filed <br />application or permit or whatever you want to call it, so that you can determine if the activity next <br />door is under a permit, and then if there is something going on and they haven’t filed some kind of <br />permit or notice with the County, then you can base the inquiry to the Planning Department of the <br />fact that “hey, there is this activity going on, I don’t think they are permitted,” and then that would <br />give the Department a basis for going and doing an investigation. Something, and it says whether <br />you are minor or major or, and what’s your expected count is and expected activities you have on <br />the property. <br /> <br />PALMA GLENNIE: Well, Bobby Jean, I mean, yes, yes, yes, yes, I think a permit has to be <br />required. But then again, what’s allowed by the permit is what I’m concerned about. Yes, a permit <br />is I don’t even think there should be a question of that, I don’t understand why there wouldn’t be, <br />but what’s allowed is huge. And I don’t think, you know, if I hear an ATV running around, which I <br />do, and as it’s running around, round and round, and people are yelling and screaming, “Ah hah,” <br />you know, and I call and, yes, they have a permit. Is that, how much better do I feel? I feel like that <br />isn’t an ag activity, I feel like the County has let me down, I feel like the County has let a huge area <br />of the law down really. <br /> <br />LEITHEAD TODD: Part of the problem is ATVs is that State Law allows open area recreational <br />use on Ag land. And it’s the same reason why you’ve got Zipline tours on Ag land because it’s an <br />open area recreational use. I’m not, I think they were trying to protect maybe horse rides, trails, <br />hiking, that kind of thing. But the other thing with ATVs is, where we had difficulty is there are <br />ranchers and others who are actually using ATVs to access part of their property, and so it became <br />very difficult for us to, we did have complaints, and so unless we see like a track, you know, and <br />they are inviting guys to come in, it’s very difficult for us to enforce because there can be legitimate <br />uses. So we’ve been able to shut down where there has been like an ATV track and they’ve invited <br />guys to come and race, but beyond that it’s been very difficult because it’s difficult for us to, if <br />somebody says, “Well, I’m using this so I can go check my fence lines” or “I use it to get to the <br />remote part.” And I recognize that it’s a noise issue for neighbors.
