<br />Mr. Arai stated that due to an oversight on notification requirements the Commission cannot hear <br />st <br />the matter today, and the Department has scheduled it for the August 1 meeting. <br /> <br />There was no one from the public wishing to testify on this matter. <br /> <br />UNFINISHED BUSINESS – 10:00 a.m. <br />APPLICANT: RODNEY AND LORRIE DIAMOND (SPP 13-150) <br /> <br />Adoption of proposed Findings of Fact, Conclusions of Law, and/or written Decision and Order <br />regarding the application for a Special Permit to allow the establishment of a baseyard for <br />parking, storage and maintenance of well drilling equipment, materials and supplies on a 0.43- <br />acre portion of a one-acre parcel situated within the State Land Use Agricultural District. The <br />property is located between Paradise Drive and Maku‘u Drive on the makai (northeast) side of <br />rd <br />32 Avenue, approximately 1,500 feet from its intersection with Paradise Drive, Hawaiian <br />Paradise Park Subdivision, Kea‘au, Puna, Hawai‘i TMK: 1-5-17:112. <br /> <br />The Commission took this item up at 10:27 a.m. with 1 person from the public in attendance. <br /> <br />The Chair stated the proposed Findings of Fact, Conclusions of Law, and/or written Decision and <br />Order was provided to the Commission and applicant. <br /> <br />The applicant, Rodney Diamond, requested that proposed Condition 2 be amended so that the <br />life of the permit for the baseyard would be for 10 years instead of 5. He said because of the <br />investment they have made they would like to remain where they are instead of relocating to <br />another site within a four-mile radius if one comes available. He added if the life of the permit is <br />nd <br />for 10 years, he would be retired within that time, noting that a special permit on 32 Avenue <br />had a 10-year life. <br /> <br />Mr. Kanuha said the Planning Department would be receptive to allowing a 10-year life of the <br />permit if that is the wish of the Commission. <br /> <br />It was moved by Commissioner Henkel and seconded by Commissioner Gonzales that the <br />Commission adopt the proposed Findings of Fact, Conclusions of Law, and Decision and Order <br />with Condition 2 amended to read, “The life of the permit for the baseyard shall be for ten (10) <br />years from the effective date of this permit.” A roll call vote was taken and motion carried with <br />five ayes (Henkel, Gonzales, Heaukulani, Miyasato, and Ishibashi) and two absent and excused <br />(Moses and Ono). <br /> <br />MINUTES – The Commission took up the following at 10:33 a.m. <br /> <br />Approval of Minutes of the June 6, 2013 meeting – It was moved by Commissioner Gonzales <br />and seconded by Commissioner Henkel that the minutes be approved.
