Hawai‘i Police Commission Regular Session Minutes October 18, 2013 Page 3 EXECUTIVE SESSION Commissioner Bertsch moved to meet in executive session to consider discipline and charges against officers or employees of the Hawai‘i Police Department, to consider sensitive matters relating to public safety, and to consult with Corporation Counsel on questions and issues pertaining to the commission's powers, duties, privileges, immunities, and liabilities pursuant to HRS 92-5 (a) (2) (4) (6) and the Hawai‘i County Charter Section 13-20 (b). Commissioner Schutte seconded, and it carried unanimously. Executive session convened at 9:35 a.m. Regular session reconvened at 10:41 a.m. ACTION BY THE COMMISSION Correspondence No. 2013-13, request for legal representation for Officer Robert K. Pule in USDC CIV NO. 13-00465 DKW RLP. Commissioner Schutte moved to approve legal representation. Commissioner Gomes seconded the motion, and it carried unanimously. Complaint HPC 13-33: Complainant alleged that an officer spoke to him over the phone in a harassing and threatening manner. Commissioner Gomes moved to refer the complaint to the Police Chief for further investigation. Commissioner Schutte seconded, and it carried with a nay vote from Commissioner Bertsch. There was concern and discussion that when complaints are referred to the Chief, the commission is not informed of the outcome. The Chief should report back to the commission on the status of the complaint. ANNOUNCEMENTS Chair Victorine announced that the Police Commission’s next monthly meeting will be on Friday, November 15, 2013, at 9:00 a.m., in the Waimea Civic Center Conference Room, 67-5189 Kamamalu St., Waimea, Hawai‘i.
