H. Concession operators shall keep the swimming pool complex clean of any <br />food or beverage spills and all leftover food shall be removed from the <br />premises. <br />All concession operators shall comply with licensing requirements and the <br />rules and regulations of the Department of Health, State of Hawaii, for <br />handling of food. <br />The Director or the Director's duly designated representative reserves the <br />right to ban the sale of any food item which is detrimental to the health of <br />patrons or which may contribute to unsanitary conditions at the swimming <br />pool complex. <br />K. All lessees who invite or permit vendors to conduct sales of goods, <br />products, or services at activities, events, or functions conducted by the <br />sponsor must collect all applicable vendor and/or concession fees and <br />process permit applications from any vendor required to receive from the <br />Director, a permit to sell goods, products, or services at the activity, event <br />or function conducted by the sponsor and to tender the required fee. <br />L. When applying for a facility permit, every lessee shall provide to the <br />Department of Parks and Recreation a complete listing of all vendors <br />authorized by the lessee to sell goods, products, or services. A <br />concession fee shall be charged all lessees that allow an outside vendor <br />to operate at the facility's designated concession area. The lessee shall <br />not receive a credit or other discount due to no-shows or vendors that do <br />not participate in the lessee's event. <br />Section 5 Penalties Relating to the Violation of County Swimming Pool <br />Complex Rules and Regulations <br />A. The penalty for breaking any provision of this rule shall be a fine of two <br />hundred fifty dollars ($250) and/or the denial of the use of any or all <br />County of Hawaii Parks and Recreation facilities until the Director is <br />reasonably satisfied that the person intends to abide by all rules and <br />regulations, laws or ordinances concerning the person's conduct or use of <br />park facilities. <br />B. Any person aggrieved by the decision of the Director to prohibit or limit a <br />patron's use of any County swimming pool facility shall have the right to <br />appeal the Director's decision within thirty (30) days of said decision, <br />pursuant to Rule 1 of the Rules and Regulations of the Department of <br />Parks and Recreation and Chapter 91 of the Hawaii Revised Statutes. <br />21 <br />
