The Board discussed whether any more details should be added to the draft and <br />decided it was sufficient. <br /> <br /> Motion and vote: Mr. Balsis moved to approve the draft as written, Mr. Henricks <br />seconded the motion, and all members voted aye. <br /> <br />d. Petition 2013-08: Review draft informal advisory opinion requested by William <br />Hanson regarding his involvement with the Big Island Amateur Radio Club and <br />his employment as an administrative officer with the Hawai‘i County Civil <br />Defense Agency. <br /> <br /> Motion and vote: Mr. Balsis moved to approve the draft as written, Mr. Henricks <br />seconded the motion, and all members voted aye. <br /> <br /> Motion: Mr. Balsis moved to go into executive session for review of the confidential <br />items agendized therein and possible conferral with counsel. However, Mr. Adams said he <br />wanted to tell Ms. Crawford something before they did so and asked if it would be all right to <br />bring her back into the room, as she was just outside talking to the media. Mr. Balsis said his <br />motion would be on the table. <br /> <br /> Mr. Adams stepped out and asked Ms. Crawford to come back in for a moment. <br /> <br />MR. ADAMS: I’m actually not asking questions. I’m making a statement, but it’s <br />important that you hear it. <br /> <br />MS. CRAWFORD: Okay. <br /> <br />MR. ADAMS: As a part of the review of the petitions, on one of the petitions that we <br />looked at last time, there was a discussion of the process that was undertaken by the <br />department to take a look at alleged ethical code violations and the fact that a <br />department engaged in investigation of those Ethics Code violations. As a Board <br />member—I’m not speaking for the Board, but as a Board member, my concern is that <br />when it comes to the Ethics Code, I believe that the Board has the responsibility by <br />Charter and by the Code to do any investigating that comes, when it has to do with a <br />violation of the Ethics Code. Policy—different issue. Department policy that may be <br />based on the Ethics Code, probably a different issue as well, maybe a conversation. But <br />when it comes to a discussion of the Code itself, I think it’s at least clear to me that the <br />responsibility lies with the Board to hear petitions. There’s a process that’s set up for us <br />to do that, and then even to do the investigation. That’s my comment. <br /> <br />MS. CRAWFORD: Could I make one statement? <br /> <br />MR.
