INITIATOR: COUNTY COUNCIL (Bill No. 192) <br />An ordinance amending Chapter 25, Article 5, Division 14 of the Hawai‘i County Code 1983 <br />(2005 Edition, as Amended) by allowing Village Commercial (CV) zoning district uses within <br />the Industrial-Commercial Mixed Use (MCX) zoning district. <br /> <br />The Commission took this item up at 10:10 a.m. with 31 people from the public in attendance. <br /> <br />(SEE EXHIBIT E) <br /> <br />The discussion on Item No. 5 (County Council Bill No. 191) ended at 10:19 a.m. <br /> <br />The discussion on Item No. 6 (County Council Bill No. 192) ended at 10:22 a.m. <br /> <br />Chairman Gonzales called a recess at 10:22 a.m., and the meeting was reconvened at 10:42 a.m. <br /> <br />7. APPLICANTS: CONNECTIONS NEW CENTURY PUBLIC CHARTER SCHOOL/ <br />CBESS (SPP 12-138) <br /> <br />Discussion and action on the Hearings Officer’s report and recommendation on an application <br />for a Special Permit to develop a K to 12 charter school campus with dorm facilities and related <br />uses on approximately 70 acres of land situated in the State Land Use Agricultural District. The <br />property is located on both the southwest and northeast sides of Edita Street near its intersection <br />with Kaūmana Drive and adjoining the Pacific Plantation Subdivision in Kaūmana, South Hilo, <br />Hawai‘i, TMK: 2-5-006:141. <br /> <br />The Commission took this item up at 10:42 a.m. with 36 people from the public in attendance. <br /> <br />Commissioner Henkel, after reading his statement into the record, recused himself at 10:51 a.m. <br />and observed the meeting from the audience. <br /> <br />Chairman Gonzales called a recess at 11:26 a.m., and the meeting was reconvened at 11:34 a.m. <br /> <br />At 12:20 p.m., it was moved by Commissioner Ono and seconded by Commissioner Ishibashi <br />that the Commission go into executive session to consult with its attorney regarding questions <br />and issues pertaining to the Commission’s powers, duties, privileges, immunities, and liabilities, <br />pursuant to Hawai‘i Revised Statutes Section 92-5. A voice vote was taken of all <br />Commissioners present, and motion carried with five aye votes. <br /> <br />At 12:23 p.m. the Commission went into executive session. At 1:13 p.m., it was moved by <br />Commissioner Ishibashi and seconded by Commissioner Moses that the Commission go out of <br />executive session.
