<br /> <br />Mr. Balsis: We’ll be going into informal hearing. Now just to discuss the details, I’d like to <br />mention that I do agree with Mr. Henricks and that is, it is specific of the Code of Ethics, we’re <br />not discussing performance. I wish his supervisor had gotten involved, that would have been the <br />appropriate way to go, but he has not gotten involved so we’re going to be looking specifically at <br />the ethics issue. We will not be looking at the condition of the pool or any of those items. It’s <br />going to be specific to your discussion that you had with him. <br /> <br />Mr. Henricks: And also, if we should start ordering supervisors before the Board every time an <br />employee does, we’d be setting a bad precedent because it’s not in the County Ethics Code. <br /> <br />Mr. Balsis: So noted. Any further discussion on that? So we’ll be moving forward, thank <br />you very much. We’ll be moving on with the agenda. I’d like to take a short break before we go <br />into unfinished business for 5 minutes or so. <br /> <br />Mr. Ranfranz: Question. <br /> <br />Mr. Balsis: Yes. <br /> <br />Mr. Ranfranz: Could this informal meeting be held in Kona, because Derek is over there, and I <br />don’t know where his supervisor is. Could that be held in Kona? <br /> <br />Ms. Schoen: It’s something we can talk about and we can let them know. <br /> <br />Mr. Balsis: We will discuss that and let you know. <br /> <br />Mr. Ranfranz: Okay. <br /> <br />Mr. Balsis: Thank you for the suggestion. So we’re going to take a break for 5 or 10 minutes <br />and we’ll be right back. <br /> <br />The Board was in recess from 11:14 a.m. to 11:20 a.m. <br /> <br />* * * * * * <br /> <br />Mr. Balsis: We’re going to move on to unfinished business. Petition No. 2014-01, review <br />draft informal advisory opinion regarding the Petition by Michael Drutar on whether the <br />Department of Finance may find a violation of the Code of Ethics and sanction on the basis <br />thereof. That particular informal advisory opinion has been circulated. I know I’ve reviewed it, <br />it looks okay with me. Is there any other discussion? <br /> <br />Ms. Schoen: Mr. Chair, I believe this morning the Board was provided with a letter from Ms. <br />Noda requesting that Findings of Fact number 2 be amended. I’m not sure if everybody got a <br />chance to look at that. <br /> <br />Mr. Balsis: I did not. That’s okay. Oh, there is it. There was one small change that was <br />noted by Ms. Noda are there any problems with having that change done by anybody here? In <br />that case, the Chair will move that the draft informal advisory opinion be accepted with the <br /> <br />20 <br /> <br />
