Hearing no opposition, the motion is passed that Petition No. <br />2014-01 the draft informal advisory opinion is approved with the one small modification. Next <br />item on the agenda is Petition No. 2014-03, informal hearing of petition by Duane Kanuha, <br />Planning Director, requesting an informal opinion from the Board as to whether legal <br />representation of a person before the Planning Commission by a former County employee, in a <br />proceeding before the Windward Planning Commission, would violate Section 2-91.2 of the <br />Hawai‘i County Code. Is Duane here? <br /> <br />Ms. Schoen: Mr. Chair he is not. I did speak with Mr. Kanuha this morning. He apologized to <br />the Board that he was unable to be here. He did express that the issue before the Planning <br />Commission was whether or not Ms. Kawauchi was allowed to represent a party before the <br />Planning Commission because there was a question of her last date of employment as a County <br />Clerk and also as a Prosecutor. We did receive email from Ms. Kawauchi stating that she would <br />provide the Board a written response but we have not received anything from Ms. Kawauchi. <br /> <br />Mr. Balsis: At this point in time I’m going to ask members of the Board if they have any <br />opinions on continuing this or letting it go away. <br /> <br />Mr. Adams: It’s my opinion we should continue it. I think this is a matter that is in our <br />wheelhouse but I’m not prepared to make a decision without at least seeing or hearing from <br />somebody. <br /> <br />Mr. Balsis: Is that the consensus? <br /> <br />Mr. Henricks: I guess the only other opinion is that it’s been here three times now and nobody’s <br />done anything and I don’t, I think they should make the next move to put it on, and put it on <br />formally, next time instead of by letter. <br /> <br />Ms. Schoen: Whatever the pleasure of the Board is. I believe Mr. Kanuha was here the last <br />two times, it’s just this morning he was unable to be here and then I think what we were looking <br />for is a response from the Respondent because she had represented at the Planning Commission <br />that she filed something with this Board but she did not, so it’s really a matter of the Planning <br />Commission not feeling comfortable with moving forward.
