<br /> <br />Mr. Adams: Thank you. <br /> <br />Mr. Balsis: Are there any other questions at this time? I’m going to ask that you just stay <br />there just in case we do have some questions that we can ask. Is there any discussion at this time <br />at the Board? Would you like, please. <br /> <br />Mr. Adams: Sure. It’s, as I take a look based on the continuation of my question there, as I <br />take a look at this section… <br /> <br />Mr. Balsis: Yes. <br /> <br />Mr. Adams: …first of all I should say that any decision, as my understanding, any decision <br />that we make can be based on any section of the article that we decide it needs to be based on if <br />that’s the case. But of course the petition comes forward and it needs to be based on a particular <br />section or sections. I’m not aware, necessarily as I take a look at the sections that have been <br />identified for this particular petition that he, that 2-83(b) (3) and (5) necessarily fit here. If I was <br />going to say, and so that’s my first point. The second point though is if I take a look at <br /> 2-83(a)(3) where it says all persons shall be treated in a fair, courteous and impartial manner, <br />based on the testimony and the evidence we’ve had placed before us, I would consider that the <br />section that there may be decision we would make on it. <br /> <br />Mr. Balsis: Actually I agree with you and that was, well they talked about sections 3 and 5, <br />but they do just talk about fair treatment. So I do agree with you. Are there any other comments <br />or questions at this time? <br /> <br />Mr. Henricks: I’d like to comment. <br /> <br />Mr. Balsis: Go ahead Mr. Henricks. <br /> <br />Mr. Henricks: The reason I put my question in that area because that’s the area that I was <br />stressing in the first place, and that’s, I think, the area that we’re concerned about today. What I <br />was trying to show is that any of these things acting alone may not be a violation of the Code of <br />Ethics, but taken together and you draw a big picture here you have a County official going into <br />a residential area to make an inspection. He knows that the neighborhood is unfriendly to each <br />other. He knows that these people don’t like each other. What does he do, he does the worst <br />thing possible, he goes into one of their homes and has a coffee break with one of the opposing <br />parties. And while in the home he discusses the other party’s violations and infractions. And to <br />make it even further worse, and exacerbate the situation, and as it was said, he tells the other <br />party that these people have filed a complaint against them. Which he says he normally does not <br />do. He telling me himself, I don’t usually tell the other party who the complainant is. In this <br />case, he did. Why? I have no idea, but all I know is it’s making a bad situation worse. And he <br />was the cause of it and in doing so, he violated this particular section of the Code. <br /> <br />Mr. Balsis: Thank you for those comments. Are there any further comments? I’m going to <br />ask do we go with a motion or how do we move forward with this at this point in time counsel. <br /> <br /> <br />36 <br /> <br />
