Commission for hearing us this morning and hearing on what Mr. <br /> Revell has to say. So again I do apologize for not getting back to <br /> you. In addition to the statement I wanted to just add that this bill <br /> didn't come from any organization or any group. It came from the <br /> constituents that called me and said we have issues in our <br /> community. They're the ones that spearheaded this bill in the first <br /> place so that's where this all came from. That's what I didn't add <br /> in my letter that I'd like to just put that down for record for the <br /> Commission to look at. That's all I pretty much had to say and I'm <br /> open for questions. Just to reiterate again the sincere apology that <br /> I didn't get back to you. My letter pretty much states for the <br /> record why, reasons happen why it's difficult to. I mean it's not <br /> difficult but it just there's a lot going on so hopefully you read the <br /> letter and you can ask me questions. I'm here to any answer any <br /> question that you might have. <br /> Mr. Balsis: The Chair does not have any questions. How about Doug? <br /> Mr. Adams: Point of Clarification. In your letter, you make the statement to my <br /> knowledge the Coalition for Tobacco Free Hawai`i does not fit the <br /> definition as a lobbyist since as a 501(c)(3) Tax Exempt <br /> organization they're staffed by volunteers to receive no <br /> compensation or other consideration for their efforts. Do you <br /> know for a fact that the staff of the Coalition are all volunteers or is <br /> that your supposition for the letter? <br /> Mr. Kanuha: That's what I might understand. I don't know for a fact. <br /> Mr. Adams: Okay. Thank you. <br /> Mr. Balsis: I'd like to ask Counsel a question. That has to do with lobbyist <br /> and whose responsibility it is to make sure that if somebody is a <br /> potential lobbyist that they are registered. What responsibilities <br /> does a Council person have in making sure that if someone is <br /> lobbying with them that they are registered? <br /> Ms. Schoen: Yes Mr. Chair. I'd like to direct the Board's attention to 2-91.3 and <br /> basically our Hawai`i County Code puts a burden on the lobbyist <br /> to register. There's nothing in this section which would place a <br /> duty or responsibility on any other County officer or employee to <br /> insure that lobbyist are registered. <br /> Mr. Balsis: So is that to say it from your reading that there's no one or party in <br /> the County to make sure that lobbyist are properly registered? <br /> Ms. Schoen: That's correct. <br />
