<br />HICKCOX: Second that. <br /> <br />BEAUDET: All those in favor? <br /> <br />ALL COMMISSIONERS IN ATTENDANCE: Aye. <br /> <br />BEAUDET: Thank you. <br /> <br />EXECUTIVE SESSION – The Commission went into executive session at 12:37 p.m. by a motion <br />made by Commissioner Whittemore, seconded by Commissioner Hickox, and unanimously carried <br />by a voice vote of all members in attendance, to consult with the Commission’s counsel regarding <br />legal questions or issues pertaining to the Commission’s powers, duties, privileges, immunities and <br />liabilities. The Commission came out of executive session at 12:58 p.m. by a motion made by <br />Commissioner Hickcox, seconded by Commissioner Whittemore, and unanimously carried by a <br />voice vote of all Commissioners present. <br /> <br />BEAUDET: I’d like to call to order the Leeward Planning Commission. Thank you all for being <br />patient with us in order for us to discuss our next action. So, with that, I would like to call for a <br />motion on the matter of a hearings officer. Commissioners? <br /> <br />WHITTEMORE: I’ll make a motion that, I think it’s important, given the information that has been <br />shared and the value that both parties have claimed on this, that we appoint an outside <br />commissioner to represent us, our commission, in this hearing, I’m sorry, hearings commissioner, <br />excuse me. <br /> <br />PATEL: Outside hearings officer. <br /> <br />BEAUDET: Hearings officer instead of the Commission. <br /> <br />WHITTEMORE: Officer, not a commissioner, officer, yes, excuse me. <br /> <br />BEAUDET: Okay, so it’s been moved by Commissioner Whittemore to look for a hearings officer <br />outside the Planning Commission. <br /> <br />HICKCOX: Second. <br /> <br />BEAUDET: And seconded by Commissioner Hickox. Need for discussion, I think? <br /> <br />HICKCOX: I think, again, it’s necessary for all parties involved that we do look for a hearings <br />officer that’s outside of the Commission, one, because of the amount of time that it takes for the <br />contested case hearings to actually happen, and for the Commissioners to be present at the, or for its <br />entirety would be very difficult because we are a volunteer group, I mean we are appointed but this <br />is not our fulltime jobs so to speak. <br /> <br />BEAUDET: And, you know, beyond just the time commitment, I think the quality of service that is <br />provided to the applicant and the petitioners, is just as important, too.
