Commissioner Whittemore? <br /> <br />WHITTEMORE: Aye. <br /> <br />KAY: Commissioner Hickcox? <br /> <br />HICKCOX: Aye. <br /> <br />KAY: Commissioner Kaholo? <br /> <br />KAHOLO: Aye. <br /> <br />KAY: Commissioner Unger? <br /> <br />UNGER: Aye. <br /> <br />KAY: And Chair Beaudet? <br /> <br />BEAUDET: Aye. <br /> <br />KAY: Okay, motion carries five-nothing. <br /> <br />PATEL: Yes, so just I, because I believe there’re still some members from the public here, just for <br />your information, so, and to the parties, you’ll be contacted by the hearings officer with the relevant <br />deadlines and dates. And then for the public’s information, the contested case hearing is a little <br />more, I guess, formal than you see at these meetings. So the public is still allowed an opportunity to <br />show up and present testimony throughout the contested case hearings, but what you’ll see is that <br />the parties are able to submit documents, evidence, they are able to call witnesses, examine the <br />witnesses; so it’s sort of more like a formal court proceeding in a way. But just know that you still <br />are able to present public testimony. Thank you. <br /> <br />BEAUDET: So you’ll be informed on the date of the hearing, I think, well, prior to that, the <br />selection of the hearings officer will be made public, or communicated, along with the continued <br />date to start the hearing process. <br /> <br />FUKE: Mr. Chairman, I’d like to just kind of make comment, you know, we fully understand, you <br />know, the necessity, given the situation of the contested case hearing, but notwithstanding the <br />component, we wanted to assure the Commission that the applicant is really going to try to see <br />whether we can work out some understanding with the parties involved, and hopefully, obviate the <br />need for a full-on contested case hearing. <br /> <br />SONG: That is correct, Mr. Chairman. We have been talking and we are going to continue to keep <br />talking. <br /> <br />BEAUDET: Thank you. I appreciate that. And just from, you know, my perspective, you know, <br />we, change is hard, you know, differences of opinion are, it’s a continued process, I mean we never <br />get away from that. And, but I think, you know, the best way for communities especially like those <br />that are as special as our little town of Waimea, is finding that balance.
