I'm having...thank you for allowing me <br /> this opportunity, but I'm having a hard time crediting what <br /> I'm hearing. Robert's Rules of Order can be waived and if <br /> you waive it so I can go back or so you can go back to item <br /> number two on the agenda. You can certainly waive it to <br /> go back to item number four and hear the matter on the <br /> merits. I will point out that the Supreme Court of the State <br /> of Hawai`i has ruled that as a matter of law in Hawai`i <br /> issues...contended issues...contentious issues are to be <br /> tried on the merits if at all possible rather than on mere <br /> technicalities. I would suggest to you that...and you ask <br /> Mr. Yoshimoto if that same rule does not apply to your <br /> Commission...to your Board. In which case, I'd like to <br /> stop here and get your response to that please. <br /> Ms. Kahakalau: Well I think the response has to do with the merit piece of <br /> it and so if you would like to make your statement and then <br /> it's gonna be up to us to determine whether your statements <br /> are going to in any way substantially merit an opening of <br /> this specific petition. <br /> 21 <br />
