UNGER: Please — <br /> <br />MOORE: Bill Moore. <br /> <br />UNGER: There you go, that’s clearer. <br /> <br />MOORE: I’m representing the applicant. I live in Hilo as well. <br /> <br />SELF: Deputy Corporation Counsel Amy Self representing the Planning Director who is seated <br />on my right. <br /> <br />KANUHA: Duane Kanuha, Planning Director. <br /> <br />UNGER: Thank you. If I can remind the testifiers that we are at this time focusing, if I can <br />emphasize that the focus of the testimony right now is to grand standing, should standing be <br />granted or not in this petition. Before we get to that, I would like to address a letter that we got <br />from the petitioner requesting that Commissioner Church be recused. So at this time, <br />Ms. McMichael, would you like, we would like you to address that specifically, and then when <br />you are done, we’ll have Commissioner Church respond. So please, please continue. <br /> <br />S. MCMICHAEL: Yes, I would like Mr. Scott Church to be recused, because he is part of the <br />Kona Coast Resort Timeshares and he is president, and I feel that it’s a conflict of interest <br />because we are against the timeshares. So I don’t, I think it’s, I think you should recuse yourself <br />for fairness. I have no, I don’t even know you, nothing personal, no grudges, I just think it’s, fair <br />is fair, and I should be on even grounds here. Thank you. <br /> <br />UNGER: Thank you. Commissioner Church, this is your opportunity to respond. <br /> <br />CHURCH: Sure. Well, thanks for bringing up that project. I was involved in the project and <br />oversaw it from 1988 to the year 2000, and then I left the employ of two partners at that point in <br />time. And true, I developed three Penthouses at the Kona Coast Resort after that, which were all <br />sold by 2005. I’m not on the board, I’m not an officer in any corporation that’s associated with <br />that, and since that time have done resort condominium development. If my involvement, if as a <br />result of my involvement some 15 years ago I was to recuse myself, then I would have to for <br />virtually every real estate project that ever came before this. I’ve been involved in lot <br />subdivisions, single-family homes, high-rise residential in Honolulu, resort condominiums, and <br />some timeshare. But I have no financial interest in now these developments at this point in time, <br />so I, I cannot recuse myself, I see no merit in that. Thank you, though. <br /> <br />UNGER: Thank you, Commissioner — <br /> <br />PATEL: Mr. Chair, if I can.
