■For instance, the following policies are from the CDP and the State policies that address the <br />same issue as the CDP regarding State IAL provision followings each CDP policy. <br />*CDP says: assist the further development of agriculture through the protection of important <br />agricultural lands. (GP 2.3 (s)) <br />*HRS 205-43 says "State and county agricultural policies, tax policies, land use plans, <br />ordinances, and rules shall promote the long-term viability of agricultural use of important <br />agricultural lands and shall be consistent with and implement the following policies:" <br />*HRS 205-43 (1) says "Promote the retention of important agricultural lands in blocks of <br />contiguous, intact, and functional land units large enough to allow flexibility in agricultural <br />production and management;" <br />*CDP says: Ensure that development of important agricultural land be primarily for <br />agricultural use. (GP 14.2.3 (j)) <br />*HRS 205-43 (2) says: "Discourage the fragmentation of important agricultural lands and the <br />conversion of these lands to nonagricultural uses"; <br />*CDP 4.3.3 Land Use Policy, Policy 24 says: To preserve the agricultural character of Hamakua <br />and to reinforce existing protections, the official Hamakua CDP Land Use Policy Map <br />designates agricultural lands in the Hamakua Planning Area to be preserved for agriculture <br />and open space. Development and construction in "Important Agricultural Land" and <br />"Extensive Agriculture" areas shall be limited to agriculture, related economic infrastructure <br />and cottage industries, renewable energy, open area recreational uses, and community <br />facilities unless otherwise permitted by law. (Hamakua Community Development Plan Draft <br />For Community Review January 2016 pg.57) <br />*HRS 205-43 (3) says: Direct nonagricultural uses and activities from important agricultural <br />lands to other areas and ensure that uses on important agricultural lands are actually <br />agricultural uses; <br />HRS 205-43 (4) says: Limit physical improvements on important agricultural lands to <br />maintain affordability of these lands for agricultural purposes; <br />*ISSUE 2 COMMENTS: <br />*The CDP should distinguish between County agriculture zoning requirements; and State IAL <br />land use, concepts, and policies in the CDP that do not apply to Hawaii County until the State <br />IAL lands are submitted and approved by the LUC. <br />*The CDP should state to the effect that "Policies and matters in the CDP that are termed as or <br />related to State IAL policies that will only be effective in the future for agricultural land when <br />Hawaii County parcels are designated IAL based on the IAL list submitted to the State Land <br />25 <br />
